Cherokee Nation AG plans casino appeal
>. TULSA, Okla. (AP) - The
Cherokee N ation’s attorney
general said last w eek h e’ll
appeal a federal decision to
place casino land o f a rival
tribe into trust, a move that
recognizes the parcel as In
dian land.
,. A tto rn ey G eneral T odd
H embree said last week deci
sion by the Bureau o f Indian
Affairs to place roughly two
a&res into trust is n o t sup
ported by law.
T h e decision keeps the
United Keetoow ah Band o f
Cherokees’ namesake casino
open in Tahlequah for at least
a n o th e r year, w h en th e
15,000-m em ber tribe m ust
have the land placed in a fi
lial trust status after any ap
peals have been settled. The
BIA granted the status M on
day after deciding th at the
Cherokees and K eetoow ah
Band share the same form er
reservation land.
“This decision is every
thing to us,” said UKB spokes
man Thomas Jordan. ‘Instead
o f looking over our shoulder,
we’re moving ahead.”
T h e K e e to o w a h s, w h o
trace their history to Chero
kees w ho settled in Indian
Territory in the 1820s, have
fought for decades over the
Keetoowah Cherokee Casino,
which opened in 1986. The
Cherokee N ation has argued
the casino is illegal.
“Tim e after time, courts
have held it is the Cherokee
N ation, and no other tribe,
that has jurisdiction over this
lan d ,” H em b ree said in a
statement. “I look forward to
appealing this decision. It is
fraught with legal misconcep
tions.”
A federal judge had given
the tribe until Tuesday to win
the status. In June, the tribe
reached an agreem ent w ith
O k lah o m a’s atto rn e y g en
eral in which the tribe w ould
pay $2 m illion in damages
and agree to close the ca
sino if it h a d n ’t o b tain ed
federal tru st status. Placing
the land in tru st recognizes
it as In d ian land, w hich is
required under state law for
a casino.
