Family Education Night
Appeals could
delay payments

2010, approving the authoriza­
tion o f $3.4 billion in funds.
Since then, several key dates
have expired.
T he deadline for an in d i­
vidual to exclude themselves as
a potential participant, the dead­
line to object or comment, and
the notice o f intent to appear
and speak at the fairness hear­
ing have all expired.
The fairness hearing was ap­
proved for June 20, 2011. This
was followed by the deadline to
file a claim or register to par­
ticipate.
The last press release from
the Cobell website said appeals
are being planned in the settle­
ment. Attorneys are asking the
judge to order that challengers
each p u t up an $8.3 m illion
bond.
A m em ber o f the Sesseton
Wahpeton Oyate nation, Kim­
berly Craven, has filed a notice
in federal court that she would
like to appeal the Cobell ap­
proval. A separate notice to ap­
peal has been filed by a nonprofit
group called the Harvest Insti­
tute Freedmen Federation.

2013 timber sale assessment released
The Resource Management
Interdisciplinary Team has just
released a draft project assess­
m ent for public review. T he
draft document provides an en­
v iro n m en tal analysis o f th e
2013 Metolius Timber Sale.
The team (RMIDT) also ap­
proved four small project as­
sessments (SPAs).
T he SPAs provide assess­
m ents fo r a fuels red u ctio n
p ro je c t n ear T en in o Valley,
spring burn in g activities, an
overlay o f roads in the campus
area, and for slope im prove­
ments at the Pelton tailrace.
The 2013 timber sale docu­
m e n t w as p re p a re d by th e
Project In 'te rd is c ip fih a ry T e a m
to provide options for timber
harvest in the Upper Metolius,
Jefferson Creek and Whitewater
watersheds.
Two alternatives were formu­
lated an d num erous logging
m ethods were considered for
this project, taking into account
present resource conditions, for­
est health and public input. The
2013 Metolius Tim ber Sale is
expected to yield approximately
30 million board feet o f timber.
The document is divided into
sections explaining the purpose
and need for action, resource-
based indicators used to help the
technical staff analyze and miti­
gate environmental impacts, and
details o f the alternatives. There
are maps showing the harvest
blocks, quick reference tables to
compare the alternatives, a list
o f measures needed to mitigate
environm ental consequences,
and the Project Interdisciplinary
Team’s recom m ended alterna­
tive. I
The goal o f Alternative A is
to continue cu rren t m anage­
ment. Activities such as hunting,
recreatio n and cultural fo o d
gathering would continue as in
tile past. The only harvest pro­
p o se d u n d e r A lte rn a tiv e A
would be through conventional
salvage operations. Alternative B
is designed to harvest volume
approximating the allowable cut
for this planning area. The 2013
sale would include a treatment
area o f 3,917 acres.
Thè alternatives would have
varying impacts on water, fish,
wildlife, cultural, timber, range,
soil and economic resources and
there would also be changes to
the transportation system.

members have 30 days to com­
m ent on the proposed sale.
An appeal could delay dis­
bursement o f Cobell payments
to plaintiffs by more than a year.
O n Ja n u ary 4, 2012, the
Court issued an order schedul­
ing oral arguments for the sec­
ond consolidated appeal. This
hearing will take place on May
15, 2012.
At this time, there is no set
date when Cobell payments will
begin. Payments will be distrib­
uted in two phases once all ap­
peals have been resolved.
Historical Class payments will
be m ailed after appeals have
been resolved. Trust Adminis­
tration Class payments will be
made after the court has granted
permission to distribute those
funds.
The Cobell website reminds
class members that no payment
is required to participate. I f a
person claiming to be from the
Indian Trust Settlement asks any
class member for funds, do not
send money.

deadline has passed, identified
class members were not required
