gave the blessing, followed by introduc
tions by coordinator, Craig Graham.
About 30 people attended the open
house. There were also refreshments
and a book raffle. From here, the
library will prepare the Book Mobile to
serve the community. For information

YAKIMA (AP) — Lawmakers in
Washington are considering a proposal
to start dismantling the state’s civil ju
risdiction over American Indians, a
step many consider long overdue. But
some say they worry that restoring full
sovereignty to tribes over their m em
bers m ight subject outsiders to unfair
treatm ent in tribal courts.
Congress passed a law delegating
jurisdiction over tribes to some states
in 1953, at a period when the govern
m ent was forcing Indians to assimi
late. The law was sparked in part by
public demand for improved law en
forcement on reservations and a de
sire to offload financial burdens in the
wake o f World War II.
States such as Nebraska and O r
egon have unraveled parts o f the fed
eral m andate in the years since. In
W ashington, the idea has garnered
broad support following a series o f
meetings last year by a task force that
included law enforcement, prosecu
tors and representatives o f counties
and cities.
Some people, though, fear tribes
may fail to ensure due process for
everyone, given a perceived lack o f
separation betw een som e executive
and ju d ic ial trib a l g o v e rn m e n t
branches. They contend state courts
m ust remain an option to settle dis
putes.
Jack Yearout spent m onths trying
to get a parenting plan approved by
the tribal court o f the Yakama N a
tion, the state’s largest tribe, which re
sides on a sprawling reservation east
o f Washington’s Cascade Range.
Yearout is an enrolled mem ber o f
the N ez Perce tribe in Idaho. T he
m other o f his 5-year-old daughter,
meanwhile, has ties to the Yakama
Nation.
After several rulings in his favor,
allowing him to visit his daughter, the
Yakama Tribal Council adopted a reso
lution last summer stripping authority
over child custody cases from the
Yakama tribal courts, an example o f
the executive branch removing author
ity from the judicial branch.
“I support tribal sovereignty, but
in my case, I didn’t get due justice from
the tribal court,” Yearout Said.
T he federal law m andated civil
and criminal jurisdiction over tribes
in six states and authorized several
others to assum e jurisdiction if they
cljose. W ashington did so in 1963,
assum ing state involvem ent in such
m atters as juvenile delinquency, tru
ancy, m ental illness and ado p tio n
p ro c e e d in g s a n d e n a b lin g sta te
courts to hear cases involving Indi
ans.
Tribes have long considered the law
a breach o f the treaties guaranteeing
their sovereignty.
