Agency calls for Willamette dam fish passage
(AP) — A federal agency says
three upstream dams in the
Willamette Valley should have
fish passages if the stream's
chinook salmon and steelhead
are to avoid extinction.
The National Marine Fisher

quired as part o f a settlement
in a lawsuit filed by two Oregon
groups.
The groups sued in 2007,
charging that federal agencies
were dragging their heels instead
of taking steps to protect fish.
The chinook and steelhead
are protected by the Endangered
Species Act.
The agency says the dams
and other parts o f the basin's
flood control project keep the
fish out o f their historic spawn
ing grounds upstream and dam
age their habitat downstream.
It says w ork on all three
“downstream fish passage facili
ties” should be finished by 2023.
It also calls for a variety o f
other measures to keep fish
populations going in the mean
time.
The chinook that spawn in
the upper Willamette are “cur
rently at a high risk o f extinc
tion,” the service said. The steel
head have spawning habitat
more widespread in tributaries
n o t affected by dams in the
project, it said, “which is why
their risk of extinction is not as
high as Chinook salmon.”
Tax refund
available to
some members
Some tribal members may be
eligible for a federal fuel tax re
fund in certain situations.
According to Policy Planner
Elmer Ward, there are specific
categories of users who can file
for a federal fuel tax rebate.
Form 8849 refers to situa
tions in which a refund can be
issued for non-taxable use of
fuels.
Ward said several uses may
apply to tribal members, such
as the use o f fuel on a farm for
farming purposes, for off-high
way use, in a boat engaged in
commercial fishing, or for ex
clusive use by a non-profit edu
cational organization.
The fuel tax refund allows for
an 18-cent refund per gallon
used.
While he is not offering legal
advice, Ward said, this informa
tion could prove useful to tribal
members who would like to
seek out information.
To see if you are eligible for
a refund, visit www.irs.gov and
search fo r form 8849 and
schedule 1.
With questions, Ward said,
contact the Internal Revenue
Service at 1-800-829-1040.
