(AP) - Federal officials are investigat ing how National Archives docu ments of interest to American Indians suing the Interior De partment were found discarded in a trash bin and a wastebas ket. The discovery came to light on Sept. 1, when Archives staff noticed federal records in one of the trash bins behind the National Archives Building near the Capitol. They notified the Archives' inspector general, Paul Drachfeld, whose staff recov ered the documents. They found at least a portion of the documents were Bureau of Indian Affairs records dat ing to the 1950s, according to Jason Baron of the Archives' office of general counsel, in a letter last week to an Interior Department official. Brachfeld's office began in vestigating, and "what appear to be Indian records were discov ered in a waste basket in the stack areas at Main Archives," Baron wrote. Taken together, the two dumping incidents "may be intcnrional acts aimed at un lawfully removing or disposing of permanent records from the Interior Department," he wroie. Lawyers for the Indian plain tiffs suing the Interior Depart ment over lost royalties ran across Baron's letter two weeks ago in a routine court filing by Justice Department lawyers on behalf of Interior's Office of Trust Records. Dennis Gingold, the plaintiff's lead attorney, said the discovery represents more of "the same repugnant, desperate actions we've come to expect" from the Interior Department. Dan DuBray, an Interior Department spokesman, pointed out that the documents were not in the custody of his agency. I le said the department was told by the National Ar chives that all the discarded documents had been found within restricted locations at the Archives. Former governor out of hospital SAI.KM (AP) - Former Gov, Vic Atiyel) was released from the hospital recently alter being admitted for breath ing trouble, a family spokesman said, Atiyeh, 82, suffered a heart attack on Aug, 30 and underwent a bypass operation the following day at Portland's Providence St. Vincent Medi cal ("enter, He was released from the hospital, but returned after nurses at his home called the hospital to report his breathing troubles. Family spokesman Denny Miles said he was told by doc tors that Atiyeh's shortness of breath may have been an after effect of the operation or due to his years of smoking, w hich he iiiit 10 years ago. Atiyeh, long time friend of the Confederated Tribes of Warm Springs, served as governor from 1979 to 1)K7.
