Spilyqy Tymoo September-15, 2005 Tribal Council resolutions V n I PQ 12 Appeals court Whereas, pursuant to Warm Springs Tribal Code, Section 200.250(1), the Tribal Council ap pointed a Selection Commitiee to review candidates for the positions of the Warm Springs Appellate Court; and, Whereas such Selection Com mittee has been unable to meet and the Tribal Council hereby exercises its authority pursuant to Article V, Section l(s) of the Constitution and By laws to review the actions of the Selection Committee and to make appointments to the Appel late Court; now, therefore; Be it resolved by the Twenty Third Tribal Council of the Con federated Trilcs of Warm Springs, pursuant to Article V, Section 1 0,(1) and (s) of the Constitution and By-laws and Warm Springs Tribal Code 203.001(1) that: Barbara Starr, Iadonna Picard Squicmphen, Floyd Calica, Ginger Smith, George Clements Sr., Edna Gonzales, Gerald Danzuka, I lamilton Greeley, Mary Danzuka, Kirby I leath Sr.,Buford Johnson Jr., and Perthina White have been appointed as appellate court judges of the Warm Springs Appellate Court, effective August 23, 2005; and, Be it further resolved that such appointment is for a one year pro bation, pursuant to Warm Springs Tribal Code, Section 203.001 (4) af ter successfully completing proba tion be appointed for a two (2) year term ending August 23, 2008. (Resolution No.10,552.) Enrollment Be it resolved by the 23rd Tribal Council of the Confederated Tribes of the Warm Springs, pursuant to Article III, Section 2 (a) as amended, of the Constitution and By-Laws, the following are enrolled members of the Confederated Tribes of the Warm Springs: Sammy James McBride Billy Chinook, Mikeal Devan Craig, Lenso Race Hanchor, Noalani Joann Harry, Sophia Maxine Mar garet Henry, Gigt Leda Hintsala David, Dana Jolene Hurtado, De sire Ann Hurtado, Elana Fay Hurtado, Raymond Lloyd Hurtado, Treyvon Leray Johnson, Mia Roe Kalama, Susan Joy Keiser, Danajolcne LeClaire-Jones, Charlie Andrew Martinez, Jose Anthony Yahtin Martinez, Sabastian Martinez, Pierre Sincere War-Child McCloud, Jaedon Dean Sorrclhorse, Tanaya Ida Mae Tewee, Ryanna Beth Thomas, Rosaleen Marie Yahtin. (Resolution No. 10,541.) mote Tribal Member entrepreneur ship and to improve the business environment at Warm Springs; and, Whereas the mineral resources of the Confederated Tribes of the Warm Springs include significant mineral deposits of economic value; and, Whereas the Tribe has con ducted industrial mineral resource inventory investigations in 1995, with assistance from the State of Oregon Department of Geology and Mineral Industries, to better understand the extent of the min eral resources under the Trilxrs con trol to consider their development, yet the Tribe still lacks complete in formation needed to fully under stand and expand the use of these resources; and, Whereas the Tribe has invested its resources to update and expand its production capability to meet current and future market de mands; and, Whereas the Tribe cannot re main competitive without locating, accessing, and devck ping commer cially viable hard rock deposits of basalt as alternative aggregate re sources; and, Whereas in view of the Tribes desire to determine the feasibility to market its construction aggre gates, the Tribe needs to define: (1) commercially viable reserves of these resources; and (2) develop ment options; and, Whereas the Tribe, with the as sistance of the B1A Division of Energy and Mineral Resources, has initiated assessments of its min eral reserves; and, Whereas the Tribe wishes to uti lize BIA professional staff to ac complish the assessment work; and, Whereas the Tribe is using funds from the BIA Mineral As sessment Grant Program which has led to increased knowledge and utilization of mineral resources for Tribal and commercial use; now, therefore, Be it resolved by the 23"1 Tribal Council that it endorses the com mercial development of any poten tial mineral resources which are dis covered under this project, and will consider public release of resource information gathered under the project in accordance with accepted Tribal information management policies and protocols, and, Be it further resolved by the Tribal Council of the Confederated Tribes of Warm Springs, pursuant to Article V, Section 1 (a) and (d) of the Constitution and By-Laws, takes this action. (Resolution No.10,542.) Mineral deposits Whereas the Tribal Council is the governing body of the Con federated Tribes of the Warm Springs Reservation of Oregon; and, Whereas the Tribal Council es tablished an Economic Develop ment Branch in 1988 to coordinate Tribal economic development ac tivities, to create new job opportu nities for Tribal Members, to pro- Road work Whereas the Tribal Council is the governing body of the Con federated Tribes of the Warm Springs Reservation of Oregon; and, Whereas the Bureau of Indian Affairs and the Confederated Tribes of Warm Springs have recognized the need to submit nine (9) envi ronmental assessment (NEPA process) projects for fiscal year 2005 as a Modification to AE 902 Engi neering Design Services Contract CTlWrt 4534. These pr jects are: P09450, WSIR 944-Kahnecta Chip Seal, $1,1 50. P09304, WSIR 8(8)-Kahneeta Slide Repair, $5,750. P09304, WSIR 805-Charlic Canyon, $5,750. P09304, WSIR 8(7)-Kahneeta Junction, $11,500. P09601, (new PCAStf), WSIR 945 - Chip Seal Campus, $2,300. P09404, WSIR 33(l)-County line Road Rcconst, $1 1,500. P09901, WSIR 75(6)-Grceley I leightsE. Tenino Bypass, $5,750. P09484, WSIR 4(8)-East Tenino Drainage Repair, $2,300. P09509, WSIR 15(l)-Sidwalter Bus Route Rcconst, $11,500.00 (Total: $57,500.) These environmental assess ment projects arc an integral part of the future of Warm Springs housing plans to school bus routes; and, Whereas these projects have been designated as part of the Bu reau of Indian Affairs roads inven tory and the Bureau has identified the funding source for the environ mental assessments to be through the Indian Reservation Roads Pro gram under the Transportation Inq uiry Act for the 21" Century, ad ministered by the Federal I lighways Administration; and, Whereas the Bureau and the Warm Springs Project Engineering Department estimate that the cost for these projects is approximately $57,500; that an actual cost pro posal will be negotiated for the purpose of entering into a contract between the Bureau of Indian Af fairs and the Warm Springs Project Engineering Department; and for which Advance Payment Schedule Process for funding shall be re quested: and, Whereas the Warm Springs Project Engineering Departments mission exists to ensure that the public good of the Confederated Tribes of Warm Springs is served through responsible engineering and construction; and, Whereas this project can best be expedited and accomplished by the Confederated Tribes of Warm Springs, by and through its Project Engineering Department; acting under Public Law 93-638 contract with the Bureau of Indian Affairs and by utilizing materials located on the Reservation and in close prox imity to the projects; now, therefore, Be it resolved by the 23rd Tribal Council of the Confederated Tribes of the Warm Springs Reservation of Oregon, pursuant to Article V, Section 1 (a) and (d) of the Consti tution and By-Laws, that the Warm Springs Tribes request a contract under auhority of PL. 93-638, to accomplish design of the above listed projects; and, Be it further resolved that the Confederated Tribes of Warm Springs request that the Bureau of Indian Affairs waive the provisions of 25 CFR 271.2 (d) ad 271.12 (a)(5) for the purpose of this con tract; and, Be it further resolved that the Secretary-Treasurer of the Con federated Tribes of Warm Springs or his authorized designee is hereby authorized to make application for, negotiate and execute said contract and any amendments thereto, on behalf of the Tribe.
