One person was transported to the
accident last week on Highway 26,
Fishing regulation
Resolution No. 10210: Whereas the
Treaty with the Tribes and Bands of
Middle Oregon of June 25, 1855; re
served to the Confederated Tribes of the
Warm Springs Reservation of Oregon,
off-reservation fishing rights at all Usual
and Accustomed stations, including
Sherars Falls and oilier locations on the
Deschutes River; and,
Whereas the Tribal Council regu
lates Treaty Indian fishing for conser
vation and other purposes to the Tribal
Constitution and By-Laws Sections
340.310 of the Warm Springs Tribal
Code; and,
Whereas the Tribal Council has been
advised by the On and Off-Reservation
Fish and Wildlife Committees and the
Department of Natural Resources tech
nical biological staff that the predicted
return in 2002 of Deschutes River wild
fall Chinook salmon destined for above
Sherars Falls will be slightly higher than
the escapement goal and accordingly,
the Tribal Council believes some re
strictions on the Treaty Indian Fishery
for wild fall Chinook salmon are ap
propriate; now, therefore.
Be it resolved by the Twenty-Second
Tribal Council of the Confederated
Tribes of the Warm Springs Reserva
tion, pursuant to Article Section 1(e)
of the Constitution and Warm Springs
Tribal Code Section 340.311), that the
conservation regulations are hereby
adopted for the 2002 treaty Indian sub
sistence fishery on the Deschutes River
during the fall Chinook Salmon time
period (August 1 to December 31,
2002).
Beginning August 1, 2(102, subsis
tence fishing at Sherars f alls will be al
lowed up to a harvest cap of 500 wild
adult Chinook salmon. This represents
17 percent of the predicted return of
3,002 adult fall Chinook salmon above
Sherars balls.
Once the adult Chinook salmon
harvest cap has been reached, fishing
will remain open for hatchery (fin
clipped) steelhead only, until Decem
ber 31", 2002.
Fishing will be allowed seven days
per week.
All wild (non fin clipped) steelhead
must be released unharmed into the
Deschutes River.
The only fishing methods allowed
will be dip net, set net, and hook and
line, as set out in Warm Springs Tribal
Code 340.310.
Pacific lamprey (eel) harvest will be
allowed continuously throughout the
fall fishing time frame.
All Chinook salmon and steelhead
caught are for subsistence purposes
only. No sales to the public are allowed.
Monitoring of the tribal harvest, fish
escapement over Bonneville and the
Dalles Dam and fish escapement above
Sherars balls will be used to determine
if in season harvest modifications will
be necessary.
Hunting regulation
Resolution No. 10211: W hereas the
Tribal Council of ihe Confederated
Tribes of the Warm Springs Reservation
of Oregon, closed the Warm Springs
Reservation to big game hunting by
Resolution No. 6587; and.
Whereas the Tribal Wildlife Code
requires the Tribal Cfuincil to review
the status of wildlife populations an
nually; and,
Whereas the Tribal Council has re
viewed the attached limits, seasons, and
oilier regulations as recommended by
the Natural Resources Department and
the On Reservation Fish i: Wildlife
Committee; now, therefore

Resolution No. 10211: Whereas the
Tribal Council has reviewed the "2002
Management Agreement for Upper
Columbia River Falls Chinook, Steel
head and Coho," and,
Whereas the Tribal Council has been
advised that the 2002 Management
Agreement for Treaty Indian and non
Indian fisheries in the Columbia River
is the result of extensive negotiations
between the parties the United States v.
Oregon; and.
Whereas the Tribal Council has been
further advised that the Treaty Indian
fisheries in Zone 6 of the Columbia
River provided for under the 2002 Man
agement Agreement are consistent with
both the Tribe's treaty allocation rights
and with the conservation needs of the
resource; and,
Whereas the Tribal Council believes
that approval of the "2002 Management
Agreement for Upper Columbia River
Fall Chinook, Steelhead and Coho" is
in the best interest of the Tribe and its
members and will serve to protect and
preserve the off-reservation Treaty fish
ing rights secured in the Treaty with
the Tribes of Middle Oregon of June
25, 1855; now, therefore,
Be it resolved by the Twenty-Second
Tribal Council of the Confederated
Tribes of the Warm Springs Reservation
of Oregon pursuant to Article V, Sec
tion 1 (a), (1) and (u) of the Tribal Con
stitution, that the "2002 Management
Agreement for Upper Columbia River
ball Chinook, Steelhead and Coho" is
hereby approved; and,
Be it further resolved by the Tribal
Council that the Chairman, or his des
ignee, is hereby authorized to sign the
2002 Management Agreement on be
half of the Confederated Tribes of the
Warm Springs Reservation of Oregon.
Brunoe appointed
Resolution No. 10216: Whereas rep
resentative of the National Congress of
American Indians (NCAI), the Depart
ment of Interior (DOI) and various
Indian Tribes have formed a joint task
force to evaluate and recommend pro
posals to improve the management of
Indian trust funds and trust assets to
the BIA, DOI and the U.S. Congress;
ami,
Whereas the tribal representatives to
this Trust Reform Task Force (TR'IT)
are 2 tribal representatives from each
of the BLVs 12 regions plus an alter
nate; and,
Whereas during the July 22, 2002
TRIE session, the NW Region's alter
nate member resigned, thus creating a
vacancy; and,
W hereas the Vice-Chair for the Con
federated Tribes of the Warm Springs
Reservation of Oregon (Tribes) was
appointed by the remaining NW Re
gional TRTF representatives and con
firmed by the TRTF as a whole; and,
Whereas the Tribal Council for the
Tribes deems it desirable for the Vice
Chair to accept the appointment and
to participate fully in all TRTF func
tions, meetings, work sessions and ac
tivities; and,
Whereas the Tribal Council ac
knowledges that substantial travel will
be required for which the BIA, on be
half of the TRTF, will reimburse the
tribes; now, therefore
Be it resolved by the Twenty-Second

Section 1 (a), (d) and (I) of the Tribal

Be it further resolved that the Vice
Chair shall, as much as possible, first
consult with the Tribal Council prior
to voting on, or taking a position on, a
matter that may affect the trust rela
tionship between the federal govern
ment and the tribes.
Sherars Bridge
Resolution No. 10212: Whereas in
1979 the Confederated Tribes of Warm
Springs purchased 888 acres of land
comprised of parcels of Deschutes Ris er
frontage between the City of Maupin
and to a point below Sherars balls; and,
Whereas the most significant parcels
of land contained in the purchase are
commonly referred to as1 the Sherars
Bridge Site, the White River Camp
ground, Sandy Beach, and the Oak
Springs Campground; and,
Whereas the Warm Springs Tribal
Council previously adopted Warm
Springs Tribal Code Chapter 341
"Sherars Bridge Management" as an
amendment to Ordinance 65 "Law and
Order" by Resolution No. 6470 on
June 6, 1983; and,
Whereas the Tribal Council subse
quently amended the Sherars Bridge
Management Code by Resolution No.
6651 on April 9, 1984 to govern all of
the lands acquired in the purchase; and,
Whereas the lower 100 miles of the
Deschutes River in which the Tribes'
Sherars Bridge Site is located is now
governed by a comprehensive plan
adopted by the State of Oregon, the
United States, and the Confederated
Tribes of Warm Springs pursuant to the
Tribal Wild and Scenic Rivers Act, the
Federal Wild and Scenic Rivers Act, and
the State Scenic Waterways Act; and,
Whereas comprehensive manage
ment of the Lower Deschutes River is
carried out pursuant to a Memorandum
of Understanding entered into between
the Tribe, the Bureau of Land Manage
ment, and the Oregon State Barks and
Recreation Department; and
Whereas a new management plan for
Tribal lands at the Sherars Bridge Site
has been developed by the managing
agencies and approved by the Tribal
Council; and,
Whereas implementation of the
management plan will require certain
amendments to the Sherars Bridge Man
agement Code; now, therefore
Be it resolved by the Twenty-Second
Tribal Council of the Confederated
Tribes of the Warm Springs Reservation
of Oregon, pursuant to Article 5, Sec
tion l(k) and (I), of the Constitution,
that the amended Warm Springs Tribal
Code Chapter 341 "Sherars Bridge
Management" is adopted and that such
amendment constitutes an amendment
to Ordinance 65 "Law and Order."

taining the peace, safety, morals, health
and general welfare of the members of
the Confederated Tribes of Warm
Springs, regulating the use and disposi

law and order on the reservation; and,
Whereas Warm Springs Tribal Code
Section 300,325 provides thai the Tribal
Council may order ihe exclusion of any
nonresident members from ihe terri
tory of the Confederated Tribes at ,inv

this individual is not a member of the

of the following acts: Breach of peace;
Violation of any tribal ordinance; and,
Crime, as defined by state, federal, or
tribal law (convicted of federal charge:

Whereas Tribal Council has deter
mined that it is in the best interests of
the Confederated Tribes and its mem
bers to permanently exclude Wanblee
Smith from the territory of the Con
federated Tribes of Warm Springs, Or

Be it resolved by the Twenty-Second
Tribal Council of the Confederated
Tribes of the Warm Springs Reservation
of Oregon pursuant to Article V, Sec
tion 1 (h) of the Tribal Constitution,
(that the Tribal Council hereby perma
nently excludes Wanblee Smith form
the territory of the Confederated Tribes
of Warm Springs.
Boarding schools
Resolution No. 10205: Whereas by
memorandum dated April 18, 2001, the
Bureau of Indian Affairs announced a
policy prohibiting Indian students from
attending off-reservation boarding
schools from outside of their tribe's
attendance area; and,
Whereas the only off-reservation
BIA boarding school within the atten
dance area for the Warm Springs is the
Chcmawa Indian School in Salem, and,
Whereas Warm Springs tribal mem
ber students have in the past attended
off-reservation BIA boarding schools
outside of the Warm Springs attendance
area, specifically the Sherman Indian
School in Riverside, California, and the
Riverside Indian School in Anadarko,
Oklahoma; and,
Whereas the Tribal Council believes
that Warm Springs students should
have the opportunity to attend any BIA
off-reservation hoarding school of their
choice, regardless whether that school
is located within or outside the Warm
Springs attendance area; now, therefore
Be it resolved by the Twenty-Second
Tribal Council of the Confederated
Tribes of the Warm Springs Reservation
of Oregon, pursuant to Article V, Sec
tion 1 (a), (1) and (u) of the Tribal Con
stitution, that Warm Springs tribal
member students should be permitted
to attend the Bureau of Indian Affairs
boarding school of their choice, even
if such boarding school is located out
side of the "attendance area" assim:

Resolution No. 10209: Be it re
solved, Jacqueline Thomas Swanson,
Enrollee No. 1082, requested relin
quishment, so that she could be en
rolled with the Muckleshoot Tribe,

Be it further resolved by the Tribal
Council of the Confederated Tribes of
the Warm Springs Reservation, pursu
ant to Article III, Section 4, of the con
stitution, that Jacqueline Thomas
Swanson, Enrollee No. 1082, request
for relinquishment is accepted on this

That Jacqueline Thomas Swanson
shall not receive any per capita, bonus
or other distributions or benefits of
Tribal membership effective July 29,

ervation to purchase an undivided 1

negotiated consideration of $150.46.
