The Warm Springs Tribal Coun
cil, on May 31, 1996, enacted the
following resolution 9234 which
sets the Sherars Bridge spring
chinook fishery for tribal members.
"Whereas, The Tribal Council
(governing body) rescinds or modi
fies existing resolutions based on new
information and other pertinent data;
and
"Whereas, new information con
cerning the status of the rule and
regulations adopted in Resolution

to make more effective enforcement,
monitoring and reinforcement of the
Tribes' basic concern relating to
conservation; and
"Whereas, The Tribal Council has
been advised by the Fish and Wild
life committee and the Department
of Natural Resources Technical

return of Deschutes River wild spring
chinook salmon returning to the
Warm Springs River will continue to
require some restriction on the treaty
fishery for spring chinook salmon;
and,

Whereas, The Tribal Council
recognizes the hardship placed on
Tribal members with harvest restric
tions, as adopted by Resolution in
the past, but with concern for the
future of the fishery resource; now,
therefore
"Be it resolved, By the Twentieth
Tribal Council of the Confederated
Tribes of the Warm Springs Reser
vation of Oregon pursuant to Article
V Section 1 (e) of the Tribal Consti
tution and Warm Springs Tribal Code
Section 340.310 (2), that beginning
immediately and ending June 14 at 6
p.m. fishing will be conducted at the
Sherars Falls area with the following
adopted regulations:
"1. In recognition of the tradi
tional methods of fishing from scaf
folds using hoopnets and setnets, will
be allowed from sunrise Monday
morning through 6 a.m. Sunday,
through June 15, 1996. Fishing will
be closed 6 a.m. Sunday to sunrise
Monday morning form the present to
June 15, 1996.
"A. All wild steelhead must be
released and returned to the river
unharmed.

"b. All wild chinook must be re
leased and returned to river unharmed
by hook and line fishers.
"c. The provisions of WSTC
340.310 (8), requiring that setnets
and hoopnets are attended continu
ously, will be enforced.
2. Hook and line fishery (single
hook only and no treble hooks) will
be allowed five days a week from
sunrise to sunset Wednesday morn
ing through sunset Sunday. Fishing
will be closed sunset Sunday to sun
rise Wednesday through June 15,
1996.
"3. The Natural Resources De
partment and Police Department shall
closely monitor the fishery and
strictly enforce the regulation re
quiring the release of unmarked
steelhead and the release of unmarked
chinook by hood and line fishers.
"4. Monitoring of the fishery will
determine if in season modification
are appropriate based on harvest rate
and updated run sizes.
"5. The Warm Springs River and
all of its tributaries are closed to
chinook salmon and steelhead fishing."
