present and voting, any and all powers delegated to the Authority by this
Housing Code or any amendments thereto, except as provided in WSTC

The Tribal Council of the Confederated Tribes of the Warm Springs
Reservation would like to announce the following vacancies:
Kah-Nce-Ta Board of Directors (2 positions-Class III)
Kah-Nce-Ta Plan of Operation (Article IV Board of Directors)
Section 2. Classification and Term of Office
(3) Class III shall consist of two members, one of whom shall be a member
of the Tribe and one of whom shall be a nonmcmbcr of the Tribe. Class III
directors shall have an initial term in office expiring December 31, 19997,
or until their successors are appointed and take office.
Section 7. General Powers-Regular meetings. Regular meetings of the
Board of Directors shall be held quarterly in the months of February, May,
August and November. The first regular meeting in each fiscal year shall also
be the annual meeting of the Board of Directors. At the annual meeting of the
Board of Directors, the Board of Directors shall review the preceding year's
operations, elect officers and transact such other business as may come
before the meeting. The regular meetings shall be held at the time and place
specified by the Chairperson of the Board in the notice of the meeting. If the
day fixed for the regular meeting falls on a legal holiday, or is otherwise
inconvenient or unsatisfactory in the opinion of the Board of Directors, or the
Chairperson of the Board, the Board of Directors or the Chairperson of the
Board may fix another date in lieu of the regularly scheduled meeting date.

Water Board (1 position)
Water Management Plan
1 . Water Control Board consisting of three members will be appointed by
the Tribal Council. Board member shall have an initial term in office expiring
October 30, 1997, or until their successors are appointed and take office.
Primary function of the Committee will be to review all matters pertaining
to the water resource to make recommendations to the Tribal Council in
regards to making the Water Management Plan function and to propose
changes or improvements in water policy and the plan.
2. The Water Contr61 Board will be concerned with all activities occurring
in the watershed areas on the Reservation. Before an activity is initiated all
plans will be submitted to the Board for their recommendations to the Tribal
Council to insure that neither water quality or quantity is impaired.

ber for the purpose of reviewing the
preceding three months' operations,
making plans for the ensuing three
months' operations, and the transac
tion of such other business as may

the Board of Directors. At the annual

Appellate Judge (1 position)
WSTC 203.001 (1) "The Warm
Springs Court of Appeals shall con
sist of judges appointed for a term of
three years by the Tribal Council.
The judges shall be adult members
of the Confederated Tribes. One of
the judges shall be appointed as Chief
Appeals Judge by the Tribal Council
and shall be responsible for adminis
tering the Court of Appeals."
WSTC 203.01 (2) "At least three
judges assigned by the Court Ad
ministrator and approved by the Chief
Appeals Judge shall sit as the Court
of Appeals panel on each case. The
Court Administrator shall rotate as
signments so that each judge sits on
an approximately equal number of
cases."

WS Composite Plan of Operation (Article III)
Section 1. Initial Board of Directors. The business and affairs of WSCP
shall be managed and controlled by a Board of Directors. Notwithstanding
any other provision of this Plan of Operation, until such time as the Council
shall appoint a Board of Directors, the Council shall act as the Board of
Directors.
Section 2. Number. The Board of Directors shall consist of five directors.
The number of directors of WSCP maybe increased or decreased from time
to time by amendment to this Plan of Operation. No decrease in the number
of directors shall have the effect of shortening the term of office of any
incumbent director.
Section 3. Classification and Term of Office, (a) The Board of Directors
shall be divided into three classes, designated Class I, Class II and Class III
as follows:
(1) Class I shall consist of one individual who shall be either a member of
the Tribe or a nonmember of the Tribe who is interested in the economic and
social development of the Tribe and its membership and who possesses
expertise in marketing, management, manufacturing, finance, banking or
some other field which would benefit WSCP. The Class I director shall have
an initial term in office expiring on the December 3 1 , 1 996 next following the
Class I director's appointment by the Council, or until a successor is
appointed and takes office.
(2) Class II shall consist of two individuals, one of whom shall be a
member of the Tribe and one of whom shall be a nonmember of the Tribe who
is interested in the economic and social development of the Tribe and its
membership and who possesses expertise in marketing, management, manu
facturing, finance, banking or some other field which would benefit WSCP.
The Class II director shall have an initial term in office expiring on the
December 31,1 997 next following the Class II director's appointment by the
Council, or until a successor is appointed and takes office.
(3) Class III shall consist of two individuals, one of whom shall be a
member of the Tribe and one of whom shall be a nonmember of the Tribe who
is interested in the economic and social development of the Tribe and its
membership and who possesses expertise in marketing, management, manu
facturing, finance, banking or some other field which would benefit WSCP.
The Class III director shall have an initial term in office expiring on the
December 3 1 , 1 998 next folio wing the Class III director' s appointment by the
Council or until a successor is appointed and takes office.
(b) After the expiration of the initial term of Class I, Class II and Class III
directors, the term of office of each of said classes shall be three years from
the expiration date of each class as set forth above, or until their successors
are appointed and take office.
(c) Directors shall be eligible for reappointment.

I, Tim J. Wainanwit, am writing
this letter of apology to the people of
the Confederated Tribes of the Warm
Springs Reservation of Oregon, the
Warm Springs Tribal Police
department and to the victims of my
outburst on the nightearly morning
of the 3rd day of December 1994.
First of all, to the WSPD, sorry for
resisting arrest on that early morning.
I don't know what suddenly came
over me because I usually go along
peacefully with Warm Springs finest
(police officers).
Also, to my sister Jessica Tufti
and homeboy Taylor Arthur. I
severely damaged my sister's Toyota
pickup by busting out her taillights.
Taylor, sorry for the
misunderstanding that we had. I know
that I was highly intoxicated and if
you all didn't take me to the jail to be
detoxed, I would have froze out there
on the road.
Finally, to the community, sorry
for my actions that early morning
and I hope that you accept my utmost
apology because I am truly sorry for
my behavior.

Last September 2, 1 was arrested
on three marijuana charges,

marijuana.
I felt that is should have been
thrown out of court but it wasn't! So
I apologize for the whole ugly mess I
got into! I woke up inside an eagle's
nest and I was trained by an eagle. I
keep a sacred pipe I have taken care
of my sweatlodge for twenty years I
have been on seven vision quests. I
have officiated seven funerals for my
relatives! That is what my life is
about ! I am sorry I got into this mess !

Faulty toasters
recalled
In cooperation with the Consumer
Product Safety Commission,
Warning Products of New Harford,
CT is voluntarily recalling its "Dualit
Plus" electronic toasters. The toasters
pose a possible fire hazard. Waring
has received reports that the toaster
turned on by themselves after
electrical power interruptions. Two
reported instances involved singeing
or scorching of areas adjacent to the
toaster.
The toaster was sold nationwide
through Williams-Sonoma catalogs
and retail stores from October 1993
through September 1994. The two
slice model has the following
numbers on its base plate located on
the bottom of the toaster: "CTS2E
DOM and 11EA36." The four slice
model has the following numbers on
its base plate located on the bottom
of the toaster: "CTS4EEOM and
11EA42." The units involved bare ,
serial numbers between 3 1 0 and 408.
The serial numbers can also be found
on the base plate.

received lease money from your In
dian trust lands anytime between
March 3 1 , 1987 and January 1 , 1994,
which caused an SSI overpayment,
and you were not living in the State
of Washington at the time, you may
not have to repay all or pan of the
overpayment, or you may be able to
get a refund of money that has been
collected from your SSI checks.
The possible refund or reduction
of your SSI overpayment is the result
of a settlement of Barney vs. Shalala,
a class action filed on behalf of eld
erly and disabled Native Americans
in Washington Slate. Federal law has
also changed and beginning January
1994, up to 52,000 per year of lease
income from Indian lands will not be
counted against you as income for
purpose of SSI eligibility.
You may not have to repay an SSI
overpayment because of income you
received from Indian trust lands, or
you may receive a refund of SS I, if all
of the following apply to you: 1) You
had an overpayment because of lease
income from Indian land; and 2) your
overpaymentexisted as of October 1,
1993, or was assessed after that date
for any period between March 31,
1987, and January 1, 1994; and 3)
you were living in Washington state
when you received the lease income.
In certain situations, refunds could
go to family members of deceased

efited from the lawsuit
