Greenhouse Program designed for business owners Tribe to file motion in support of Lyle Point issue The Small Business Center is holding the ONABEN Small Business Greenhouse Program for those individuals interested in starting their own business. The two part Greenhouse Program contains a Discovery Class and Greenhouse Class. The four week Discovery Class helps individuals assess whether they possess the types of personality traits required to own and operate their own business. The students will also be provided with a basic business overview and components of a detailed business plan. The ten week Greenhouse Class addresses all the business areas needed to successfully start and operate a small business. Topics to be discussed include the following: Identifying business start-up opportunities. Developing a detailed business plan. Marketing your business services and products. Bookkeeping and lax compliance. Budgeting and money management. Insurance, licensing, and bonding requirements. The Greenhouse Small Business Program will begin March 2, 1994 at 6:30 p.m. to 9:30 p.m. at the Education Center (Old Boys Dorm), Training Room 1. To attend the Discovery class you must pay $50. To attend the Greenhouse Class you must pay $ 1 00, totalling $150 for both classes. For additional information or registration, please contact the Small Business Center at 553-3539. The Warm Springs Confederated Tribes were set to file a motion to intervene in Federal District Court in a Yakama Nation lawsuit in efforts to halt a luxury development at Lyle Point on the north side of the Columbia River. The legal action targets Klickitat County Commissioners and Columbia Gorge Ltd. The brunt of the Warm Springs motion to intervene and memorandum in support of the motion was the treaty rights of the Warm Springs people and their right to fish at Lyle Point guaranteed in the ColumbiaRiver Fishery Management Plan of 1988. The motion cites the Treaty with the Tribes of Middle Oregon of June 25, 1855 and the Columbia River fishery Management Plan of 1977 and subsequent plans which created an exclusive Indian fishery in Zone 6 on the mainstem Columbia. Attorney Ted Roy of the Roy and Pell firm in Yakama was retained to handle the motion on behalf of the Warm Springs Tribal Council. The motion to intervene was accompanied by a lengthy memorandum and an affidavit by Douglas Palmer of Lyle Point, an enrolled member of the Warm Springs Confederated Tribes. The memo states that the 1855 Warm Springs treaty reserved for its people the right to fish at "usual and accustomed stations" on the river, including Lyle Point, and of "erecting suitable houses for curing (fish)." The memo states "the Warm Springs Tribe has significantly protectable interests relating to the property (at Lyle Point), and is so situated that disposition of this action may impair or impede its ability to protect those interests." The memo argues that the current suit does not protect Warm Springs rights because the Yakama Treaty of 1855 protects only the rights of the Yakama people. And the documents warn that if the court does not grant the motion to intervene, Warm Springs "would simply bring a separate lawsuit against the defendants which would eventually be assigned to this court. The Palmer affidavit, meanwhile, documents a long residency of the PalmerfamilyatLylePoint,thecareer of fishing for self-support by the family, and the recent covert destruction of two fishing scaffolds used by the family in fishing. The 11 -member Warm Springs Tribal Council voted in mid December to join the suit. The Yakama Nation last November 23 filed suitagainst the Klickitat County Commissioners and Columbia Gorge Ltd. to halt construction ot luxury homes at Klickitat Landing on grounds the development violates the Yakama Treaty of 1855. Deputy Court Clerk Pam Posada of the Eastern District Court, meanwhile, notified the parties February 1 that a status conference on the case will be conducted April 13 by Federal District Judge Alan McDonald. The status conference will touch on matters of service of process on additional parties, jurisdiction and venue of the case, anticipated motions, anticipated discovery moves, recommended dates forcutoff of discovery, possible consolidation of actions, potential reference of the case to a magistrate, anticipated trial time, prospects for settlement, and modification of pre-trial procedures.
