The Madras White Buffalo girls traveled to meet the Riverside Pirates on Feb ruary 15, 1991 and ran into some rough waters as the Buff gals had to dig deep to pull this one out. With the ticker about to hit the buzzer Becky Soliz let a 3 pointer fly which rattled the hoop for a second and finally fell through to tie the score at the end of regula tion play to force the game into overtime. The Buff gals led 17 to 14 at the end of the first quarter where Michelle Simmelink canned four baskets in that quarter. They led 32-28 at halftime. At the end of the third quarter the Buff gals had a ten point lead 44-34. In the fourth quarter Riverside made a despera tion comeback to out score Mad ras 20-10 and almost won the game. Madras was called 19 fouls and Riverside 18. Kari Ded fouled out for Riverside. Michelle Simmelink led the scor- r ing for the Buffs with 16, Becky Dodson II, Heather Clowers 10, Kris King 7, Allison Kirsch 6, Becky Soliz 3, Luanne Foltz 3,. Laura Sahme 2, Carol Miller 2, j Arlinda Duff, Margie Durette and Shirley Allen. to In the first three quarters the girls really played tough defense, but in the fourth quarter with lack of experience the Riverside Pirates i almost took advantage of that and nearly came away with a big win. It was a heart breaker for the host , team, but a joyous one for the visit-: ing Buffaloes. The Buffaloes host the Baker ... ' Driving Under the Influence of Intoxicants Continued from page 1 of driving under the influence of intoxicants and are arrested for DUII, you will be asked by a police officer to take a breath test to determine your BAC. This is al lowed under Oregon's implied con sent law. This law says that, by driving on the public roads and highways of this state, you agree to take such tests. If you fall If you take the test and your BAC exceeds the allowable maxi mum for your age and license group, you will not be allowed to drive for a 12-hour period. You will have to figure out another way to get home, because you will not be allowed to drive for the next 12 hours. You may be given tempora ry 30-day permit to drive, but then again you may not. It depends on your record and whether the ar resting officer decides to confiscate your licens. You also will be given a suspension notice that takes effect in 30 days. On the 31st day, your license to drive will be sus pended for 90 days to one year. you refuse If you refuse to take the test, it's worse. Refusing to take a test will get you a longer suspension than taking and failing the test. You cant drive for the next 12 hours. You may be fined up to $2,500, be sentenced up to one year in jail, or both. Or, instead of a jail sentence. you may be told to do community service. You also will pay assess ments anH fpp If this is your first DUII, the judge will order your driving li cense and your right to apply for a license suspended for one year. Before you can get your license back, you will have to file proof of future financial responsibility for three years. This means you will have to show proof of insurance, which means you will have to pay in advance for insurance for three years from the date your suspen sion ends. And you can bet that with a DUII on your record, your insurance rates are likely to be much higher than they were before you decided to do something dangerous, illegal and expensive. If this is your second or more DUII within five years of a first conviction, your driving license will be suspended for three years, and youll still have to file proof of future financial responsibility. So you think it's no big deal to be suspended because you can get a hardship permit? It's not quite that easy. If you appiy tor a hardship permit You may be able to get a hard ship permit if you can prove you need it to drive to and Irom work or on the job. Other limited uses are allowable, such as visiting your physician. But you are limited to specific times and specific routes. And the hardship permit is not free. '! To get a hardship permit, you must meet conditions set in the law and by DM V rule. Conditions vary with suspension, and for DUII offenses they are very strict. You will have to file proof of financial responsibility and pay a hardship permit application. After a second DUII, you must file proof of finan cial responsibility, pay the hard ship permit application fee, and wait for a least 90 days after your license has been suspended. After a third DUII conviction, you cannot get a hhardship permit for one year. If you are a repeat offender, you will have to supply a letter of recommendation from the Office of Alcohol and Drug Abuse Pro grams that says you are success fully progressing in an approved alcohol treatment program, before you can apply for a hardship permit. If you dirve on your hardship permit when or where you are not supposed to, or if you violate any other conditions of the permit, it w ill be revoked. Your fees will not be returned, and you may be arrested and tried for driving w hile suspended. That's a felony charge, you may or may not get a tempo rary 30-day permit to drive, and you will be given a suspension notice that takes effect in 30 days. But the length of the suspension will be longer for one to three years. If you're under the limit But, you think, there's no prob lem if you're 18 years of age or older, you take the test and it shows less than the maximum allowable BAC. Wrong. If you take the test and it shows any alcohol in your blood at all, that reading can be used as indirect evidence in court to decide if you are guilty of DUII. If you're charged If you are charged with DUII, you are not allowed to forfeit bail or plead guilty to a lesser charge as a way to get the DUII charge dropped or dismissed. There's no way out. Still interested in doing some thing dangerous, illegal and expen sive? Read on. If you divert The court may let you partici pate in a diversion program instead of going to trial for DUII. But it's still not a way out. You get to pay lots of money in fees and penalties, even if the court places you in a diversion program. And you are not always eligible to divert. You will not be able to divert if you have diverted in the last 10 years. You also may not be allowed to divert if yo'i have an other DUII charge pending or if in the last 10 years you have had put on your record a conviction for murder, manslaughter, negligent homicide or assault with a vehicle. You also cannot divert if you had a traffic accident in which someone was injured at the time of your arrest. If you can divert, it is still an expensive process. You will have to pay the cost of the examination of your drinking problem and other assessments. You also must pay for whatever alcohol treatment pro gram you take. The court also may require you to attend a victim impact session. If you are required to do so, you will have to pay a fee to the victim impact program. The cost can total well over $1,000. If you do not live up to your diversion agreement with the court, you will face a DUII trial and penalties if you are convicted. If you go to trial 9 If you decide not to divert, or you are not allowed to divert, and you undergo a trial, it may take place before a judge alone or with a 1 judge and a jury. Once you're in court, if you plead guilty or are found guilty of DUII, it is Class A misdemeanor and if you're convicted, you may get to spend some time in jail as well as pay a large fine. If you stop and think So the next time you're tempted1! to do something dangerous, illegal1 and expensive, take a few moments to think about it. Think about it before you start drinking, because ' alcohol affects your judgment.' Plan in advance to have someone ' else drive, to call a cab, or to walk. ' ' But don't drive intoxicated. It's;' really not worth it. l J Community Center Calendar February 21 Public Meeting at 6:30 p.m. Agenda: Recrea tion. Public is encouraged to attend.
