Attorney represents Mitchell in appellate court case
As each school year comes to
a close and all the kids are out
for the summer, I see an entirely
different world today than
when I was a kid. There are so
many changes in life styles. I see
changes from tough work out in
the fields for the kids in the past
and the jobs kids have today.
Like my kids have asked me,
"How was it in the olden days
when you were a kid?" Some
times I think they thought I was
making up stories of what it was
like. Per capita was $21.00 per
year, man I thought I was in a
dream world getting all that
money. The jobs kids had were
no joke. Kids were lucky to find
any kind of jobs around here. I
can remember the first job I had
when I was a kid. I pitched hay
for a whole week and after all the hay was hauled, it was payday.
I sat out on the porch in the shade waiting for my pay. Finally the,
"Head Honcho," comes out and said, "Well, you've pitched hay
for 4 full days and today we finished before noon so I figure I owe
you .45c. He plunked the money in my hand and went back into
the house. All my thoughts of buying things melted away like the
cube of ice in my glass of kool aid.
I also remember the days when school was out and we would
load up the car and head for the Willamette Valley to pick berries,
Believe me those kinds of jobs are no picnic. From early morning
through the long hot day we worked, in the evening eat and hit the
sack. This would go on all summer until it was time to go back to
school. Boy, those old tough looking Government teachers looked
like Raquel Welch and it was great to be back, for the first few days
that is and then they would look like themselves again....
The point I'm trying to come to is, I'm sure glad the kids can
come out of school and have jobs throughout the organization for
the summer or as long as the program lasts. And if the kids are too
young to work they can sign up for summer "Recreation. "They do
a lot of fun things at the Community Center all week long and on
Fridays they go on field trips like to the High Desert Museum,
Skate World, Swimming at the Cove, the Enchanted Forest near
Salem, and the Zoo in Portland. There are all sorts of fun things
they do.
Yep! I sure wish I could have waited until now to come into this
old world. ..and to think of it, some kids think its child abuse if they
have to clear the dishes off the table. Seems like the only thing
missing from this article is, "Captain Jack, and the Old Timer,
from the WAY IT WAZ." Ahh-NahYun-Wy or Shun Wy.

With the kind of weather we've been having here lately, one
could say that fire season is here. Boy, everything is bone dry, all
the limbs, twigs and grass in the woods. Could start a pretty hot
fire. Thats when a lot of timber fires crown is because of so much
dry fuel underneath. As it is now the "Hot-Shot" crews have been
covering a lot of country from Arizona to Alaska fighting fires. I
just hope they don't have to fight any large fires here.

The Warm Springs Appellate
Court is called upon to make a sig
nificant tribal constitutional deci
sion that affects each person sub
ject to the civil jurisdiction of the
tribe.
In Isaac Mitchell vs. Confeder
ated Tribes of Warm Springs, Mr.
Mitchell is asserting that he be
allowed to enforce the tribal con
stitutional provisions of free speech,
free assembly and promotion ot
general welfare and the tribal cor
porate charter's "sue and be sued"
clause. The case arises out of Mr.
Mitchell's support of the union
strike in the summer of 1988.
The lower court granted the
Tribes' motion to dismiss finding
that the Tribe as a government and
corporation was protected by sov
ereign immunity. Essentially the

This letter is long overdue, but I
thought that I would let you girls
know how I felt about our season.
I really enjoyed the short time
that I had spent with you. Girls as a
team, you played really well. All of
you showed a lot of improvement
from the beginning. If we gave a
MVP, I would give each of you
one. I felt that you had your heart
in the game. You keep on practice
ing every chance that you can. .

a truck driver.

To the editor,
Alex Tufti & Marc Arthur; give
credit where credit is due. The
credit for the coaching of the
Warm Springs 'stars' should go to
the boys who did all the hard work.
Be proud of yourselves that you
did a really good job. You boys had
the time and patience to work with
the girls. With your help they will
go on and improve their skills.
1 am sorry that I missed out on
most of their season. But as I
watched them play, I felt proud of
you guys. While watching you.
work with the girls, you enjoyed
yourselves, teaching them the
basics of the game.
As I told the girls, take care of
yourselves and enjoy your sum
mer. I love you.

To the editor,
The unfortunate illusion here is
the same as on our reservation in
New Mexico. That is that the tribe
is a bottomless bank account. A
rising population number and
increasing housing construction
costs are combining to make for a
bleak future. ...more and more

To the editor,
My few days in the hospital were
very rememberable. I had received
many phone calls as well as cards
and flowers and the visitors never
quit coming. I will always cherish
those times and the caring words
that were given too me, and not
omitting the prayers that were
offered. I will never forget my neice
that made my stay there joyful, I
thought that I could never laugh
from down deep as I did there, she
made me laugh and enjoy my stay
there as we shared the same room,
and that is Rosa Brown, who was
my private secretary, she answered
all my phone calls for me. I have a
special place in my heart for her.
After you have read this piece in
the paper, I would have been
through my surgery in Portland. I
will be on my road to recovery and
well on my way home. If people
would like to call to find out how I
am doing then we have two num
bers that friends and relatives can
call in Portland, these people will
keep in close contact with us.
Thank you from the bottom of my
heart to all the people that came
and shared prayers with me and my
family at my home before I came
into the hospital.

less and less ability to accomplish
that goal. Nationwide, affordable
housing is becoming a thing of the
past. And it may not be long before
per capita dividend payments will
have to be cut or eliminated.
All is not lost, however. The one
single most critical factor driving
this crisis on is a high birth rate.
The choice becomes quite clear.
Either a high quality life for a
smaller number of people or a
lower quality life for a greater
number.
An argument could be made for
saying some tribal members could
settle off reservation but that ig
nores the fact that the same thing is
happening out there. In the past, it
has been possible to allow things to
proceed without planning. Myself,
I think those days are gone. How
about you?

Now free of drugs
To the People of Warm Springs,
I would like to thank you for
sending me here to Serenity Lane. I
graduate today. It makes me feel
good to be away from the alcoholics
and drug addicts there on our
reservation. I am glad to be alive
today, to see my kids grow and be
able to lead them on the right path.
I hope all would see the same, for
our people and our kids and
families.

pass on information to all persons
having involvement with the court
system.
When you file any action against
another person, or if the Tribes
files action against you, it is your
responsibility and in your best
interests to seek legal advice as
soon as possible. You may contact
the Legal Aide Department to assist
you.
If you are seeking payment of
child support, modification of pay
ment of child support, payment of
restitution or a fine, you must pres
ent documents showing your income
and expenses with copies of billing
statements, check stubs or receipts
to verify the information. The
Judge will then review this infor
mationand takeall into considera
tion to make a fair decision. You
may also wish to include any doc
umentation or letters that will help
you prove your accomplishments,
ie: completed substance abuse treat
ment, counseling, parenting classes,
etc.
