Family Abuse Prevention resolution passed
In August, 1989 the Tribal
Council passed Resolution 7868
which allows for abuse victims
within a family household to "Peti
tion for a restraining order to pre
vent abuse", without having to file
criminal complaints or file for
divorce. Prior to this law the only
way to obtain a restraining order
was to file criminal complaints or
file for a divorce petition.
Now a restraining order is
obtained by filing a "petition for
restraining order to prevent abuse",
as per WSTC 33 1 .805 (2), family or
household members means spouses,
former spouses, extended family
members, persons residing in the
same household or persons who
resided in the same household with
in one year immediately preceding
the filing by one of them of a peti
tion under WSTC 331.810.

I) Any person may seek relief
under WSTC 33 1 .800 and 3 11 .820
and 202.120 by filing a petition

jurisdiction over all proceedings
under WSTC 331.800 to 331.820.

affected by his or her leaving the
residence or household to avoid
abuse.
3. ) WSTC 33 1.805. abuse means,
(a) attempting to cause or inten
tially, knowingly, or recklessly
causing bodily injury, or, (b) inten
tionally, knowingly, or recklessly
placing another in fear of immi
nent serious oodily injury.
When the petition is filed in the
court with specific facts of what
has happened, it is presented to one
of the judges to review and upon
the facts presented, the judge will
approve or deny the request
petition.
When a petition is granted, an
order of restraint will be issued
immediately pending a 10 day
hearing at which time both parties
will be present to state whether the
restraining order should or should
not be continued.
The Legal Aide department or
the court will be able to assist in
filing petitions.

Requests submitted for land use permits

Five requests for land use have
been submitted to environmental
coordinator Gerald Henrikson by
Warm Springs tribal members.
Lee Johnson requests a homesite
lease on tribal land in the Metoliuj
Bench area. The tract is presently
rangeland used for grazing pur
poses with adjacent lands. The lease
terms call use for a period of 25
years, automatically renewable for
an additional 25 years.
The land lies westerly of the M
100 Road in the Metolius Bench
area. No live streams are located
nearby and domestic water will be
accomplished by drilling a well.
Principle living components are
cattle, horses and wildlife. The site
is located within walking distance
of three homes but is away from all
major traveled roads.
Adverse impacts include con
struction of the home and road but
the proposed action is not expected
to harm the environment and does
not appear to meet criteria requir
ing preparation of an Environmen
tal Impact Statement according to
the Warm Springs Realty Office.
Leontyne T. Davis requests a
homesite on allotted land located
in the Wolfe Point area. The tract
is presently being used as open
range land along with adjoining
lands in the area.
Topography has a moderate in
cline. Water will be supplied by the
Deschutes Domestic Waterline.
Living components in the area
include native grasses, weeds,
sagebrush and roots. Principle
animals are cattle, horses and wild
animals. The site is within walking
distance of an established subdivi
sion but well away from the Kah-Nee-Ta
highway.
Adverse impacts, construction
of home and road, would create
initial topsoil disturbance and
long-term intensive use on the
driveway. The action does not meet
the criteria for an Environmental
Impact Statement.
Jerry Wewa requests a homesite
lease on tribal land in the Metolius
Bench area. The tract is presently
used for grazing purposes with
adjacent lands. The lease term re
quested is 25 years, automatically
renewable for an additional 25
years.
Living components include jun
ipers, native grasses, weeds and
sagebrush. Animals in the area are
cattle, horses and wild animals.
The site is sparsely populated with
several homesites in the Indian
Park turn-off area.
An access road will be built to
the site from M-100 Road.
Adverse impacts include con
struction of their homesite and
access road could be constructed
so few junipers will be affected and
will screen the site. Once estab
lished, the homesite could be kept
and maintained in a clean state.
' The preferred alternative as sug
gested in the assessment presented
by Warm Springs Realty would be
to have the applicant locate in
another rural area of the
reservation.
No Environmental Impact State
ment is recommended.
Jerry Wewa also requests a graz
ing lease on tribal land adjoining
his homesite request area in the
Metolius Bench area.
The tract is presently being used
as open range land along with
adjacent lands. The lease term is
for five years.
No live streams are located in the
area and water would be provided
by drilling a well or running a
waterline to Pipp Springs.
Adverse impacts include cons
truction of a fence cutting off open
range for a small amount of land
normally used for grazing. Topsoil
would be disturbed and impacted.
Priscilla S. Yazzie requests a
grazing lease on tribal land in the
Miller Flat area. The tract is
presently being used as open range
land along with adjoing lands. The
lease calls for a term of five years.
The land lies north of the County
Line Road (P-600) and takes in a
small growth of pine trees and a
drainage ditch. Topography is fairly
flat. No live streams are located in
the requested area. Domestic water
will have to be provided by drilling
a well.
Living components include jun
ipers, pine and native grasses,
sagebrush and roots. Principle
animals are cattle, horses, deer and
other wild animals. The site is in an
area that has several established
hoimesites within walking distance.
Adverse impacts include fencing
to cut off 76 acres of open range
land. Initial topsoil distrubance will
occur with long-term intensive use
by livestock within the fenced area.
The proposed action does not
appear to meet the criteria or action
requiring preparation of an Envir
onmental Impact Statement.
Realty asks for "go ahead"
The Warm Springs Realty Office
has requested the issuance of a No
Significant Impact and Notice of
Availability for development of the
Sunnyside Subdivision, Section 1
and 12, Township 9 South, Range
12 East, Willamette Meridian, Jef
ferson County, Oregon. The tract
is already subdivided, but an en
vironmental analysis is necessary.
The site of the Sunnyside Subdi
vision is west of Kah-Nee-Ta Road,
North of Warm Springs. Oregon.
The water supply will be served by
the Deschutes Domestic Water
System and air quality is generally
good.
Living components of the area
include native grasses, sagebrush
and juniper. No principle animal
species is located in this area and
only one homesite is located within
a mile of the subdivision.
Roads and necessary utilities are
already placed.
Analysis of' the environmental
impacts of the proposed action
indicates that adverse impacts in
clude disturbance of topsoil and
compaction during construction.
Preparation on an Enviornmental
Imapact Statement is not recom
mended as the proposed action
does not meet the criteria requiring
such preparation according to the
Realy Office.
