Flint Scott won the cow riding and also the barrel race. In placing in so many events, Scott was award ed the Ail-Around championship and was presented a pair of chaps. ' ' . . f f - 1' if mm 1 , ' ' j Warm Springs fifth grade stu dent Reggie Heath took fifth place in the Little Boy's Grass cham pionship dance in Bismark, North Dakota, The 10-year-old competed against 950 other youth dancers during the 20th Anniversary Uni ted Tribes International Powwow in September. Heath says he danced four or five times and eventually finished in the top five with 75 points, 19 less than the first place winner. He took home a ribbon and fifty dol lars which he plans to spend on his grass dance costume. In an effort to provide commun ity assistance, awareness and edu cation, the Tribal Court will be submitting articles such as the fol lowing regarding"Affidavits of Pre judice." The information and sec tions of the Tribal Code will hope fully enable you to submit docu ments necessary with all of the required information for an imme diate response by the Court. Many documents cannot be accepted and are sent back due to lack of specific information. I'm sure you've heard the statement form "Dragnet" where Sergeant Friday says. "Just the fact, ma'am." Well, that is what the Court requires, "the facts." The Affidavit of Prejudice is self-explanatory in the Code sec tion 200.270(2). The facts must be stated specifically why you believe a fair hearing or trial decision could not be received from that judge. Filing an Affidavit of Prejudice WSTC 200.270 Disqualifica tions A Tribal Court judge may be disqualified from presiding over a particular case where there is a conflict of interest, a request for disqualification or a self-disqualification. 1. No judge shall be qualited to act as judge in any case wherein that judge has a direct interest or where any party to the action is a relative by marriage or by blood in the first or second degree. Removal of the judge form the case in these circumstances is mandatory. Par ties to the case may not waive this disqualification rule. 2. A judge may be removed from the case upon the basis of an Affi davit of Prejudice which has been filed by one of the parties. The Affidavit must be in writing and must offer facts and evidence to support the request. The reasons presented must be sufficient to lead a reasonable person to beieve that the party could not receive a fair trial by the judge being opposed. Decision on the request by an impartial judge is discretionary and final. 3. In some cases a judge may elect to disqualify himself or her self. This is a personal decision and is not mandatory. Such decision will normally be made where the affected judge feels that a decision on the case could not be fairly made without bias or prejudice. This very personal decision may not be challenged.
