Cfl Grand Jurors decided Monday night not to return robbery and kidnaping indictments against a couple who escaped from the Kansas State Penitentiary so their baby could oe Dorn outside. Hernando Cotton. 49. and Mrs. Martha Stachura, 27, had been charged with kidnaping Anthony W. Trcvclick, 23, of Redwood City and robbing him of $2 last week. They were caught when a stolen car stalled and a policeman recog nized it. The jury decided it was "not In the public interest to have Cal ifornia taxpayers support them here," said Norman Elkington, chief assistant district attorney. They will be returned to Kansas. The pair told authorities here they held trysts in a prison utility tunnel and made their escape when Mrs.. Stachura found she was pregnant. The baby is ex pected in September,' Cotton told the grand Jury Mon day night ho faces life imprison ment when he returns to Kansas. He was first sent up for stealing an automobile and was later con victed of killing a fellow prisoner. Mrs. Stachura said she has enough charges against her in three states to keep her in prison or 25 years. She and her husband, Edgar, 28, were convicted of selling a mortgaged car. Stachura Monday won a parole from the Lansing, Kan., penitentiary but was re leased to Arizona authorities who wanted him on forgery charges. Gov. George Docking's office aid Oregon also wanted Stachura on charges of obtaining money through false pretenses while Cal ifornia (ought him for forgery.
