Polk County
DA Seeks to
Block Cahill
Foster Files Answer lo
CahiU's Motion
For Release
Waller Foster, district attor
ney of Polk county, has filed an
answer to Otto CahiU's motion
for release from the state Deni
tentiary pending an appeal to
the United States supreme court.
Cahill, convicted of theft of
$750 from a joint water district
on the coast, is in the state pri
son serving a one-year sentence
for the crime.
Attorney for Cahill filed a pro
ceeding with the supreme court
requesting his release pending
the outcome of the appeal. Fos
ter, in his answer relates the
history of case, pointing out that
the Polk county sheriff's deputy,
took Cahill in custody at the
Portland air base- hospital prior
to the filing of the appeal.
The Polk county district attor
ney in his answer said that the
order to take Cahill into custody
was made as soon as competent
physicians held that Cahill could
be safely moved away from the
army hospital. Cahill is suffering
from a heart ailment and is now
confined in the prison hospital.
CahiU's attorneys declared that
they thought they had 20 days in
which to file the appeal. They
also assailed prison authorities
for not permitting CahiU's wife
to visit him in the prison hospi
tal. William Ryan, secretary of the
board of control, which governs
state institutions, said it was a
firm policy to deny visitors to in
mates during the first 30 days of
servitude.
