Bakery Challenges
Dallas Peddling Law
DALLAS A suit was filed
in circuit court Thursday to test
the Dallas city ordinance on
peddling.
Plaintiffs in the action are the
Marckx Home Delivery Bakery,
Gresham, and two of its drivers,
Robert Sigfried and Elmer
Brown, both of Salem. David
Fain, of the law firm of Black,
Kendall and Fain is representing
the bakery, .
The action follows the notice
given by the city council recent
ly to the company that it was
violating the statute relative to
peddling. The bakery taking an
opposite view, contends that
since its employees have obtain
ed cards from housewives ask.
ing their representatives to call,
no license fee need be paid for
peddling, which is $5 per day
per truck. This would amount
to $30 a week as the two drivers
deliver bakery goods in Dallas
three times a week to about 360
homes, of which some 160 buy
regularly. j
Attorney C. L. Marsters terms
the suit "a friendly one," to de
termine a point of law. It is
expected that the matter will be
determined without the neces
sity of calling witnesses and
without a jury.
