Marshall, Tex., was denied Su
preme Court review of her unsuc
cessful suit in two lower federal
courts to have the law declared
unconstitutional.
The federal government took
$12.57 from ber bank account for
non-payment of taxes for domestic
servants and Mra. Abney sued for
return of the money. Hers waa a
test case on behalf of 11 Marshall
housewives.
U.S. District Judge William H.
Atwell of Dallas ruled against the
refund and the U.S. Circuit Court
in New Orleans upheld Atwell.
A 1950 amendment to the fed
eral insurance contribution act ex
tended coverage of the law to do
mestic employes and made em
ployers responsible for withholding
the tax and reporting it to the aov-
ernment.
