Delzell chairman of the board of Port land General Electric company, termed "absurd" the allegations that PGK has preferred taking a chance on dump energy to the assurance which the company's customers would have had un der long-term contracts with Bonneville Power Administra tion. "The contention that PGE would take such a gamble at the expense of its customers Is com pletely at variance with the facts," Delzell said, "and the Idea that the company has enough fat on its bones to ab , sorb the excess costs created by team generation . during the power shortage is at odds with the strict regulation imposed on us by the public utilities com mission of Oregon." Delzell said that PGE has been endeavoring, without suc cess, to secure a satisfactory lone-term contract since 1039. He pointed out that, "Back in 1041-42. . discussions about a long-term contract took place, In these discussions, Bonneville Power Administration insisted that PGE was to transfer its properties in Woodburn, Oregon, and Vancouver, Washington, to public agencies at a price satis factory to the Bonneville Power Administration; and also insist ed that BPA be given an option on the entire properties of PGE. In other words, we would have to commit suicide in order to get a contract." 'From December 10. 1941 to August 30, 1947, Delzell said, PGE secured power only on a day-to-day basis from BPA. He stated that in 194S Dr. Paul Ra ver, Bonneville Power Adminis trator, sent to Franklin T. Grif fith tentative draft of a con tract for Griffith's "personal in formation" only. This contract, which was never officially sub mitted to the company, contem plated that Bonneville Power Administration was to have an option on the property, with two years' time in which to secure authority to exercise such an option. It further contemplated that if such authorization was not obtained within the two-year period, the contract ' would be cancelled. "Even If this provision had been legal, which It wasn't." Delzell said, "it would have had the effect of giving PGE a two- year contract, after which we would have been forced out of business. "Since 1047 Bonneville has been heavily committed to oth er purchasers such as public agencies and heavy industries, and up until September JO, 1951 we did business under a ' aeries of one-year contracts. Now we have a five-year con tract under which we hope even tually to obtain a share of feder al power on a firm basis: but we have no firm power whateoever at the present time, and the contract is subject to cancella tion by BPA on three years' no nce. "Had the company been able to secure a fair allocation of federal power for the benefit of its customers, as the law con templated, it is perfectly appar ent that there would have been no need to have excess costs last fall and winter, and no need for the surcharge."
