Eugene Annexation Valid
Rules Supreme Court
The state supreme court ruled valid today the November 2,
1948 election at which Eugene annexed the South Willamette
street area.
Then the court recessed until September 6. But it will come
back to hear any emergency cases which might come up.
The suit contesting the Eu-
gene annexation election was
brought by Charles witham, a
brewery operator who lives in
the annexed territory. It was
brought against Mayor Earl Mc
Nutt and the Eugene city coun

Witham claimed the election
was illegal, charging insufficient
notices were posted, that per
sons favoring the annexation
electioneered at the polls, and
that ballots were given to per
sons who did not live in the ter
ritory involved.
But the high court, in a deci
sion by Justice James T. Brand
disposed of all of William's I
charges, which were denied by
Mayor McNutt and the council.!
The decision upheld Circuit
Judges Dal M. King and G. F.
Skipworth.
The high court also upheld
another Lane county case, this
being the suit of Leonard Stuhr
to collect compensation from
the state industrial accident
commission. Stuhr failed to col
lect a cent.
Stuhr was hired by Lane
county to haul gravel ior coun
ty roads. He was blinded when
a piece of steel flew into his
eye.
The decision, by Justice Ar
thur D. Hay, upheld Circuit
Judge King's contention that
Stuhr's accident did not occur
while he was working.

The strike was called by the
Italian Federation of Metal
Workers (FIOM), a branch ol
the communist Italian Confeder
ation of Labor (CGIL). FIOM
claims 671,000 members among
the Industry's 900,000 workers.
Members of the non-commun
ist free General Federation of
Labor (LCGIL), refused to par
ticipate in the walkout but their
numbers are small.
Apparently, the 24-hour work
stoppage was a show-of-strength
maneuver by the communist-
controlled union to back up de
mands in contract negotiations
with owners which opened in
Rom today.

followed an uncertain course in
today's board of trade session.
Off at the start, around a cent for
some deliveries, short covering
developed a rally. Later this
buying dried up and prices dip
ped again, more than losing their
early gains.
Soybeans and lard, however,
withstood the selling in grains
and at limes beans were up as
much as 5 cents a bushel for the
July delivery.
Both corn and wheat reacted
to a better than expected gov
ernment crop estimate. Flo I
talk indicated that wheat in the
Canadian privinces has suffered
considerable damage from hot
weather.
The thin rye market gained
strength on reports of damage to
the Canadian crop. Oats follow
ed the trend of corn.
At the finish wheat was 1
to 2 cents lower than yesterday's

fusing to sell gasoline to a serve
yourself firm.
Eagle Oil company, operator
of 600 filling stations, several of
the self-service type, in Los An
geles county, requested the re
straining order granted yester
day. Eagle's suit alleged that
Standard conspired to prevent
it from obtaining petroleum pro
ducts in violation of anti-trust
laws.
The complaint alleged further
that itandard requires as a con
dition of sale that retailers must
not sell at prices -lower than in
Standard-owned or controlled
stations. The suit also charged
that Standard and other major
oil firms named as co-conspir
ators but not as defendants de
prived independent stations of
gasoline to maintain a price
structure, despite a surplus of
fuel.
