and wheat, which had been weak
during the greater part of the
session, gained some strength.
Earlier in the session grains
had sold off sharply as the re
sult of yesterday's advance, but
the demand for corn and oats
checked the decline.
At the finish wheat was Ji to
2 V4 lower than yesterday's close,
May $3.02-2-3,4. Corn was 4
to 1 higher, May $2.67 -2.66

prosecution for alleged violation

ter 6, of Title 6, O.C.L.A., com

medy is not available in crimi

Referring indirectly to the i
opinion posed by the grand jury
that operation of pinball ma
chines as now conducted in the
county is illegal Governor Hall
said:
"If this is your opinion theni
it becomes your duty to indict'
the persons so engaged in such
violations. Failure to act is in
disregard of your oath of office.
"If their is doubt about the
illegality of the so-called 'free
play features of these devices,
recourse may be had to the cir
cuit court for instructions. . . .
If there is no doubt, then it is
your duty to indict, and it then
becomes the responsibility of
the district attorney to prose
cute. Under such indictment
and prosecution every question
you have raised can be deter
mined by a court of competent
jurisdiction.
"In the .history of this state,
the governor has rarely, if ever,
directed the attorney -general to
take over the functions of a dis
trict attorney unless requested
by the district attorney so to do.
or unless the district attorney
has become disqualified either
because of misfeasance or mal
feasance in the performance of
his duties, or other substantial
cause1 he continued.
"I see no reason for now de
parting from this well estab
lished public policy, a policy
founded upon reason, and in
keeping with the letter and spir
it of the constitution and laws
of the state. Your request to di
rect the attorney general to ap
pear in this matter is refused,'

Keizer, Jan. 13 A meeting of the newly organized Keizer PTA
will be held at the Keizcr school auditorium Thursday night at
8 o'clock for the purpose of electing officers for the ensuing year.

The charter has been held open
until after this meeting so that

Suicide at Mehama
Mehama, January 13 A self,
inflicted bullet this morning
claimed the life of Otto Zim
merman, 65, whose suicide was
attributed to dispondency over
his own ill health and that of
his mother, an invalid for soma
time. The body of Zimmerman
was found by Mr. and Mrs. Ken
neth Morris, who have been as
sisting in the care of his mother.
Only survivor is the Invalid

Chicago, Jan. 11 () (USDA) Salable
both Governor Hall and Secre
tary of State Newbry told the
architects that they had an obli
gation to perform for the people
of the state but did not vish to
be unfair to the firm.
The governor said that under
a letter sent by the board of
control to the architects in 1944
the state was clearly obligated
to pay six percent fee on the
first million dollar cost but con
tended that there should be a
compromise on the fee for the
remainder of the cost. He then
made his proposal which was ac
cepted by the architects and was
voted by all members of the
board.
Loan Resolution
The board adopted a resolu
tion authorizing borrowing of
$2,000,000 from the state land
board for the construction of the
office building, the money to be
amortized over a period of years
through rentals charged to state
departments occupying the new
building.
New bids will be called lor on
an elevator in the receiving ward
of the Oregon State hospital.
Only one bid was received on a
previous request for proposals
but it was found that one pros
pective bidder did not receive
the request in time to bid due to
a delay In the mails.
After Superintendent Wooley
of the boys' training school at
Woodburn had explained to the
board that foot controls on wash
basins in the boys' cottage and
shop buildings, now under con
struction, would stand up better
under "hard usage" than hand
controls, the board reversed a
ruling made last week and ap
proved Installation of the foot
control. The additional cost is
$112.53.

Describing the largest of the
supply line projects listed Man
ager Franzen said it "follows
the easterly side of the city,
crossing from east to west in
the northerly section, and down
the westerly side to Division
street, with mains crossing the
city from east to west, thus
insuring the complete circula
tion of water within the system
and an adequate supply to the
newly annexed areas, also al
lowing the expansion along the
northerly and easterly sides of
the city.
In addition to the program
listed the manager added that
"There is also to be considered
the cost of construction neces
sary to increase the present wa
ter supply by the installation of
a 30-mile pipe line from the
present head works to the De
troit dam, and the construction
of additional storage facilities
as the demand increases, for all
of which financing should be
planned."
Concerning supply the report
says further:
"The present reservoir capa
city is 10,600,000 gallons, or less
than one day s supply, which
does not insure adequate safe
ty in case of interruption of the
water supply. Six days' supply
is considered a minimum safe
storage. Therefore storage facil
ities should be increased as ra
pidly as funds will allow."
Relative to the 20,000,000-gal-lon
reservoir the manager has
previously mentioned that sites
in the West Salem hills and in
the hills east of Salem were
being considered.
School Budget Approved
At a special school meeting
held at the Keizer school Mon
day night a budget for the school
year 1948-1949 amounting to
$116,955.00 was approved. Al
though the vote was relatively
light there were no dissenting
voters. This budget it is under
stood will be submitted to the
county rural school board which
will pool the budgets of all sec
ond and third class districts in
the county and will re-submit
the total budget to the voters of
the various districts for final ap
proval in April.
It was brought out at the hear
ing on the budget that the school
authorities estimate a teaching
staff of 22 will be required next
year. The present teaching staff
numbers 14 and one part-time
music instructor. Also an addi
tional bus will be required to
augment the service now provid
ed the district with two buses.
Incidental to the budget hear
ing a request was made as to the
school board's attitude toward
co-operating in the cost of con
structing a dike along the river
bank to prevent further flood
waters from reaching the school
grounds.

Flood Closes School
As a direct result of the recent
flood, classes were held Monday
only for the first, second and
third grades at Keizer school
which are housed in the old
building.
Upper grade children were no
tified of the closure as the school
buses made their rounds Monday
morning.
Due to seepage of ground wa
ter into the furnace fire-box of
the main building the school au
thorities were told it would be
inadvisable to use the heating
plant of the main building until
the seepage no longer interferes.
School was resumed as usual
Tuesday morning for all classes
after the condition had been in
spected by a heating expert and
the healing plant judged safe to
