    Salem Will Graduate
500 Seniors on May 29
Salem high school will graduate at least 500 seniors, one of the
larger classes of the institution, the night of May 29, Principal
Harry Johnson revealed in releasing the list of those who will re
ceive their diplomas. The class is almost evenly divided between
bovs and girls, there being 251 of the former and 249 of the latter.
Of the total 95 are returned
veterans. It is possible a few
additional veterans will be eli
gible to receive their diplomas
by the time graduation day ar
rives. Dr. Morgan O'Dell, president
of Lewis and Clark college of
Portland, will deliver the com
mencement address, while Dr.
John L. Knight, assistant to
President G. Herbert Smith,
will deliver the baccalaureate
sermon the night of May 26.
Both programs are scheduled
for the high school auditorium.

a native Oregnian and has a dc

James Royce, Waltz
Composer, Suicides
Pontiac, Mich., May 21 (U.R)
James Royce, who as James
Royce Shannon wrote almost
600 songs including "Missouri
Waltz" and "When Day is Done,"
was revealed today to have
taken his own life by stepping
into the path of a freight train.
An inquest was ordered but
witnesses said it appeared cer
tain the 65-year-old composer
hurled himself deliberately onto
the tracks yesterday. He had
been suffering from asthma.
A native of Detroit, Royce
achieved his first real success
in writing the music for Chaun
cey Olcott's "Shameen Dhu" in
1912.
He wrote the lyrics for "Mis
souri Waltz" President Tru
man's favorite song in 1914.

to the retail market at prices
about 10 percent above 1941
levels, the office of price ad
ministration said today.
The full amount of increase
will go to manufacturers to

Zoning Problems Continue
To Keep Council Occupied
A battle of legal minds took up most of the city council's time
Monday night and resulted in the council approving a change ot
zone, on application of R. J. Martin, in the neighborhood of Mar-
-fket and 20th streets to permit
the establishment of a small
business. The change is from
Class I residential to Class III
business.
The planning and zoning
commission had originally re
jected the application in
grounds it was "spot" zoning,
but the case was carried into
the council.
Opponents of the change were
represented by Ralph E. Moody
and the petitioner by Chris J.
Kowitz whose arguments
threshed out the questions of
"spot" zoning and sufficiency of
notification sent property own
ers of the district prior to pub
lic hearing.
Brown Doesn't Agree
City Attorney Lawrence
Brown said he didn't agree with
either attorney on certain
points, but held to his original
contention that the application
violated the "spot" zoning in
erpretation as given by the su
preme court in the Page case
of Portland.
The council, nevertheless,
passed the bill and granted the
change by a vote of eight to
five,
Other industrial legislation
Monday night included enact
ment of an ordinance vacating
an alley north of D street be
tween North Commercial and
Front to permit the Terminal
Ice & Cold Storage company to
build an addition to its plant.
The council fixed the com
pany's fee at $500.
To serve the new Paulus can
nery now under construction in
Oak Lodge addition, an ordi
nance was enacted granting the
Southern Pacific company a
franchise to operate a spur track
for five years across an alley
in block 4 of the addition and
across Hines, Wilbur, Howard
and 14th streets. Introduced
was a bill to give the Southern
Pacific a franchise to operate a
spur on Trade and across Win
ter to serve the Valley Fruit &
Produce company. The bill will
be on final passage at the next
meeting.
Nazis Ordered
Prisoners Slain
Dachau, Germany, May 21 W)
The prosecution at the trial of
14 nazi officers and men charg
ed with slaying unarmed Amer
ican prisoners during the battle
of the Bulge read into the rec
ord today a statement that the
Germans were ordered to ignore
"all scruples and humane feelings."
The statement, allegedly
made by Capt. Oskar Klingkel-
hoefer, one of the defendants.
said that the first SS panzer
regiment received these orders.
"Ahead of us there shall be
terror and horror. We should
remember in this fight especial
ly the cities that have suffered
tremendously during the bomb
ing attacks and have suffered
great misery. Therefore all
scruples and humane feelings
shall be thrown overboard. No
prisoners of war will be taken."
A number of German elite
guard troops who participated
in the battle of the Bulge testi
fied that advance troops were
ordered to "pay no attention to
prisoners of war."
The prosecution maintains
that close to 800 American pris
oners were murdered in the ad
vance of the first panzer regiment.

Hacksaws Injure
First aid Monday was called
for Phyllis Briggs, 2235 Fourth
street, whejj she suffered cuts
and bruises in an automobile
accident in the 2100 block on
Portland road.
Mrs. Morris Hunt, 1126 Ne
braska, was taken by first aid
to Salem Deaconess hospital for
surgical treatment of a wound
on the hand caused by a clothes
wringer. Darrell Rindhaug, 9,
of 615 North 14th, cut a tendon
in a finger while using a hack
saw and was taken to a doctor.
French Rebukes
Wafer Board
Alderman C. F. French, chair
man of the sewer committee of
the city council, and sponsor of
a long-pending ordinance bill to
make a sewage service charge
on residents and industrialists,
again got the bill postponed
when it came up for third read
ing Monday night, and inci
dentally rebuked the water
commission for failure to coop
erate in expediting the bill.
The purpose of the bill is to
create a f I id to build up the
sewage treatment and sewer
line construction outlay. French
told the council that as drawn
the measure would raise S55,
000 a year from residences, S24,
000 from industrialists and S24.
000 more from other commercial
interests.

billing, hasn't yet figured out
the mechanics of printing the
bill on the monthly water charge
statement. French said he had
made inquiry of Portland and
Eugene officials and found out

Prior to the next meeting
copies of the bill are to be made
for distribution.
Mt. Crest Abbey
May Get Addition
Lloyd T. Rigdon, president
and manager of Mt. Crest Ab
bey mausoleum, has placed an
application with the civilian
production administration for an
addition to the mausoleum to
cost an estimated $75,000. The
application was filed Monday
and a response from the CPA is
exoected in the near future.
The Salem school board Mon
day filed its second application
for construction of a $78,000
gymnasium at the Salem high
school. The first application was
rejected. The new application
states the purpose is to be for
physical education classes, in
stead of games and sports.
