Appointment to the newly creat
ed position of superintendent of the
state penitentiary will be tendered
to Henry V. Meyers, retired Salem
merchant and at present general
manager of the reorganized Miles
Linen mill here, when the state
board of control holds its next
meeting the Capital Journal is re
liably Informed this afternoon.
The appointment, of Mr. Meyers,
It Is said, has been agreed upon by
Governor Patterson, Secretary of
State Kozcr and State Treasurer
Kay for several days and the ac
tual appointment has been hinging
upon the ability of the board and
Mr. Meyers to get together on the
amount of the superintendent's sal
ary, which the legislature provided
should he fivod by the board of con
trot. Negotiations were opened
with an offer of the board of $3,-
COO year which, it is understood,
has been raised to $4,000, the max
imum amount now being paid to
heads of other state institutions.
While Mr. Meyers is said to hav
met the board's first proposal with
a counter offer of acceptance at
$5,000 a year, he Is today reported
to be ready to accept the position
at the compromise figure.

tral west where many rivers and
creeks already were running flood
high as a result of heavy week end
precipitation.
Indiana probably was hardest hit
by the hiph water, hundreds of
acres of farm lands along the Wa
bash river and along both forks of
the White river being inundated.
The southern part of Terre Untile
was under water from overflowing
creeks, while the Ohio river.
Kvnnsville, had passed -the fiood
stage of 35 feet. In some area
transportation was hindered and
wire communication was hampered
by sleet.
Sleet also paid a costly visitation
In Iowa and Nebraska. The dam

The right of municipalities to enict
zoning ordinances was sustained by
the supreme court today in a cape
from Minneapolis.
The court Interpreted Its recent
decision In the zoning case from
Kuciid, Ohio, as having established
the validity of renins regulations a
proper restrictions upon property
rights, leaving open only the ques
tion ot the reasonableness of par
ticular regtialtfons.
The order of the lower courts In
the Minneapolis case, which was
broupht by Charles B. Berry, was
affirmed without comment.
Berry contended that toning or
dinances as a whole constituted un
constitutional interference with
Property rights.
