The Fall -Doheny bribery Indict
menU which were quashed several
months ago In the lower courts
here, were held to be valid today
by the District ot Columbia court
of appeals.
A plea In abatement, filed -by
Former Secretary Albert B. Fail,
Edward I. Doheny, oil magnate
and his son, Edward I Doheny,
which the lower court granted was
overruled by Chief Justice George
B. Martin on motion of the govern
ment's special oil counsel, Atlee
Pomerene and M. J. Roberta,
Two indlotmentt were covered
by the court's decision, one charg
ing Fall with receiving a bribe of
$100,000 to influence his official
action respecting certaia oil leasee
and the other charging the Doh
ony's with giving the bribe.
The appellate court held the act
of congress taking the prosecution
of the oil cases out of the hands
of the department of justice meant
only to reprlvs the attorney gener
al of the "charge and control" ot
the litigation and did not Interfere
with the right of the speolal coun
sel to make use of the assistance
of district attorneys. The defense
had argued the presence m the
grand jury room of Oliver C. Pa-
Ken, a special assistant to the at
torney geneeral, violated the
sanctity of the proceedings and nul
lifted the Indictments. This view
was accepted In the lower courts,
