shortly after 9 o'clock this morn
ing. An elaborate system Is used
for the work, an apparatus hav
ing been erected whereby the con
crete can be lifted from the mixer
straight up for some 50 feet. It
can then be poured into a series
of troughs, through which It
flows into the frames at the side
of the building.

Evidence sufficient to Insure tho
conviction and hanging of Murray
is already in hand, the authorities
neneve. But in the cose of Willos
and Kelley it is a different mat-tor.
Before they hang It will be neces
sary for the state to prove that aa
individuals they fired the shots
that resulted in the death of one
ft he guards, or that they were
parties to a conspiracy to kill if
necessary in making their escape.
Dercnse Ground Work
The prosecution has a third op
portunity to ask the death penalty
lor eitner wniioa or Kelley, or
both, if they can prove that either
or both actually assaulted an offi
cer in making the break.
Kelley. and Willos have both laid
the ground work for their defense
in statements declaring that neith
er fired a shot. But counterbal
ancing this on the part of Willos
the statement that be signed and
fingerprinted at tho Newman home
in New Era, in which it was as
serted that he shot Milt Holnian,
one of the guards killed.
The claim of Kelley that ho did
not fire a shot and never had a
gun is discounted by officers, who
point out that besides the rifle and
revolver each that Murray and
Willos carried in tho break the
trio took with them a shotgun.
