to be the big consideration back of
the stipulation recently entered
Into between the power companies
and the Irrigations on the upper
Deschutes river. The company de
siring to purchase the power site
is believed to be the Portland
Electric Power company, 0
The Deschutes rails Power com
pany and the Columbia Deschutes
Power company are both con
trolled by the Eastern Oregon ,
Land company, which is a proper
ty of the Martina, capitalize of
Can Francisco.
In making such a deal, the
traneacttnn would be facilitated if
. the selling companies were ahle
to show a perpetual right to the
water power at Shearer s Bridge.
So the main question at Issue, and
to be decided by the state engi
neer, Is whether the two com pa
tes have qualified to bold an ap
propriation of water rights madi
prior to 1909, or about ISOtt.
Prior to 1909 the law provided
that u the holder of a right show
ed due diligence Jn developing the
proposed project the right would
be perpetual. In 1909 the la
was changed limltlnc water pow
er franchises to 40 years. A pros
pectlve purchaser would hesitate
to take over a franchise that would
be limited to 40 years. Although
the companies now holding th
franchise have developed no pro
ject In the approximate 19 years
that they have held the right, It
is presumed they will attempt to
ehow that this failure has been
Justified by reason of unuvoldaMi
obstacles.

permanent home tor Capital Post

meeting of the post at the Salem
armory last night. The plana, aj
outlined by Dr. Carleton Smith,
sponsor and past commander of
the post, received the unanimous
endoraement of the assembly.
Only roluntary subscriptions
are Involved in the plana as out
lined, the amount ranging from 1
to $25, and extending over a
period of 6 years. No definite
amount was set as a goal for the
campaign, but It was shown that
with ordinary effort 16000 could
be raised by July 1, 1925.
Moving pictures were shown of
the work of the state game com'
mission, following which the post,
headed by the drum and bugle
corps, marched in a body to Mc-
