I cum bill 401, Representative
Herbert Cotdon'a mutual ravinga
bulk bill, as tinned by the govern
or Is not In the amended form that
the legislature Intended tu puma.
1'ao import. nt amendments made
by the senate and which were
nsreed upon by a conference com
nut toe of the two houses were left
out of the enrolled bill, apparent
ly through error of the house en
rolled bills committee. The ques
tion is whether, since the measure
his been signed by the governor,
nnyone has authcrlty to have It
it-enrolled in amended form.
In section 8 or the printed bill
la a sentence relating to agree
ments between mutual bank In
corporator and the state superin
tendent of banks, which In the or
iginal bill read: "Such agreement
or undertaking shall fix the maxi
mum liability assumed thereby,
which shall be a reasonable amount
approved by the superintendent of
banks, and the same shall be so-
cured to his satisfaction, which se
curity in his discretion may be by
a surety bond executed by a do
mestic or foreign corporation au
thonzed to transact, within this
state, the business of surety."
Thit sentence as amended read
"Such agreement or undertaking
shall fix the liability of the Incor
porators jointly and severally for
such reasonable amount as may
te approved or detarmlned by the
superintendent of banks, and in
addition to the uniertaking of the
incorporators Jointly and several
ly, tho superintendent of banks
may require a surety bond execut
ed by a domes ic or foreign cor
poration auth irtxed to transact,
within this state, the business of
surety."
The second sentence after the
abovs was stricken out by amend
ment, but in the bill as signed by
the governor remains In the meas
ure. It reads: "Such agreement or
undertaking and such security
need not be made or furnished
unless the superintendent of banks
shall require the same."
The errors are considered par
ticularly serious since the mutual
banking bHl Is one of the most im
porta nt acta parsed by the Icglsla
ture, and by some members was
considered the most Important.
