CONTEST FILED
BY HEIRS OVER
SHAFF ESTATE
Petition to contest the will of
Walter D. Shaft ba been filed In
the circuit court against the find
ing, of the county court. Peti
tioners to the contest are Charles
W. Shatf and Delia C. Arklson,
who claim they are the sole heira
at law of the deceased, while in
the will which is being contested
number ot other deTisees are
named.
The petitioners declare that
they secured an order bavins
George A. Smith named as admin
istrator ot the estate, but that
later, on August 19 last year.
John Bayne. attorney, appeared
before the county court with a
will which purported to be the
last will and testament of Shaft.
They state that In proceedings
before tha county court at the
tim, evidence was adduced which
showed that the will was not ex
ecuted In the presence ot witness
es, that the purported witnesses
did not know they were execut
ing their signature, aa witnesses
to a will, and that the will was
not properly subscribed. They as
sert for these reasons the will
was null and void.
However, they state, in the
face ot this testimony the county
court went ahead and admitted
the will to probate, having
George A. Smith removed as ad
ministrator, and designating
George Keech as executor, Keech
being named as such in the pur
ported will.
The petitioners ask on appeal
that the will be declared a nulli
ty, that George Keech be remov
ed as administrator and that
George A. Smith be reappointed
as executor and be permitted to
go ahead with the administration
ot the affairs of the estate.

BANKS GRILLS
"FIVE CZARS"
OF PORTLAND
(Continued from Pag, On,
'north end' and look at the vote.
You will find that the 'north end
voted unanimously for these two.'
Banks hinted at threats of
license revocations and stricter
regulation that were held over
the north end In .the election to
make It "vote right."
Referring to? criticism of his
measure that Is being spread
among members of the legislature,
he branded It as propaganda In
spired by fanatical reformers,
and characterized It as the work
of the self-constituted law-en
forcement committees, particular
ly one In Portland headed by A.
M. Churchill.
A Super Committee
"Before every election we have
these self-consttituted committees
meeting and organizing to tell the
people how to voto. Thoy get out
tlcketa and carry on propaganda
to ocieat men and measures.
"Tills super-committee in Port
land, he said, "wants the council
to nave the right to take property
without duo process of law. They
place to settle matters Involving
property rights Is In the courts.
"If wo are going to succeed In
law enforcement wo must havo
our laws enforced according to
law and by officers who them
selves observe the law," said
Hanks In taking a side fling at
the state prohibition department,
which, he said. Is undertaking to
tell local officers how they are to
enforce the law.
"This bill," ho said, "Is not In
the Interest of law violation, but
Is for proper law enforcement."
Tooze and laFollette
Senator Tooze spoke In opposi
tion to. the bill, deploring the
tondency of the courts to "drag
along" their cases.
Senator LaFolictt took a fling
at Banks.
"I remember 22 years ago. Sen
ator," said LaFolictt, "when you
were told that If you didn't vote
right for a certain United States
senator you would be sleeping In
a barn. I have seen you many
times since but I have never seen
any sttraws sticking In your
hair."
senator Joseph, opposing the
bill, pictured the old north end In
the days of the "dead line."
JoseDh Onnnses Rill
"Women whom 1 saw In those
days I have seen since they grew
old," ho said. "Many of thorn are
running rooming houses, and to do
that they must have licenses.
They become bootleggers. I care
not whether It Is theso poor un
fortunates or that grand party on
Portland Heights where the
woinrn's backs were painted with
peculiar characters and their
bosoms were painted likewise
where the women danced In
maudlin drunkenness and where
the owner was so drunk he didn't
know what It was all about when
tho officers came."
Banks had rapped raids made
on homes and establishments
without proper warrants.
"When officers raid such
places," shouted Joseph. "I care
not whether they hire March
warrants or not. I care not If
they break down the doors to get
In. I say they are to be com
mended for It."
Joseph declared these were the
people whom the Banks bill would
protect. II, drew a verbal pic
ture of th, start given young men
and women In these places on the
ro&d of liquor and drugs.
Klepper declared tb. Banks bill
would do more than anything else
to eliminate the condition pictured
by Joseph, lie eald one of the
Portland commissioners told him
last Saturday that th Banks bill
should pass. He referred to Com
missioner lllgelow, of Portland, as
a czar" who claimed the com
mission was superior to the
municipal court
Clark defended th, bill calling

eatd ho couldn't understand how
the electorate of Portland could
on the same day elect "such high
toned, eloquent. Independent,
God-fearing champions of law en
forcement as Kicppor, Banks,
Clark and Joseph, and at the Bame
time elect such scoundrels as the
city commissioners seera to be.
"May It not be," interrupted
Kleppcr, "that good men have bad
laws to enforce?"
"You were elected to the senate
to keep us from having bad laws,
retorted Garland.
