W. T. Vinton, former president of
the state senato and luw partner
of Waltei L. Tooze Jr., has issued
a statement in defense of Mr.
Tooze and concerning an Indict
ment returned against him here
on a charge of having contributed
to the delinquency of a minor
girl by giving her liquor. It fol
lows: "Naturally, I have made a thor
ough investigation of the charge
upon which my partner, Walter h.
Tooze Jr., has been indicted. Noth
ing has been concealed from uie,
and the facts revealed justify my
confidence in his innocence. His
most bitter enemy has not dared
to accuse him of the slightest at
tempt at undue familiarity with
the girl, and his conduct in taking
liquor away from her should be
commended by those who sow at
tempt to ruin bis reputation.
Attack Laid to Enemies
"Walter Tooze is of a vigorous,
forceful personality. Such a man
necessarily makes, enemies, and
unfortunately Tooze has made
bitter enemies, both as the result
of the practice of his professional
and of his participation in politics.
If Tooze were a man of less stand
ing, force and ability, he would
not now be called upon to face a
grand jury indictment. I am not
magnifying the bitterness of those
who are demanding his prosecu
tion. Yamhill county has been
divided as a result of the lawsuit
involving the tax conservation
commission act, in which litiga
tion Tooze took an active part.
Unfortunately he- incurred the
hostility of the aunt one of the
young ladies who was present at
tlio so-called party. Tooze's stand
against the. 'blue law' movement
in McMinnviHe also engendered
much bitterness toward him, and
particularly the hostility of one
of the gentlemen most ardent in
his demand for prosecution and
fearless in his conduct, and an in
tense partisan of our constitution
al form of government, and an
active fighter against all radical
movements which seek to under
mine and destroy American insti
tutions.. The radicals of our coun
try nave lined up in opposition to
him and their methods of injuring
him are characteristic of unre
stricted radical movements.
Grand Jury Criticised
"About an bour before the in
dictment was returned, and while
I was away from McMinnviHe, the
first Intimation that he was the
subject of a grand jury investiga
tion, was borne to Walter by a
friend. He immediately asked the
privilege of appearing before that
body to make a statement in his
own behalf. This privilege was
denied to him. And for the first
time in the history of Yamhill
county, so far as I have ac
knowledge, an American citizen
was refused the opportunity to
meet a grand jury face to face,
and offer evidence of his inno
cence. This action is not only un
fair, but indefensible.
"The indictment came like a
clap of thunder out of a clear sky.
Fair play and common decency
were not manifested toward Wal
ter, but even his most venomoui
traducer makes no charge against
him, except that he contributed to
the delinquency of a minor by giv
ing liquor to her. It has been in
timated that he participated in a
'joy party.' When Tooze, follow
ing his usual custom of storing his
car, drove Into the garage, he had
no knowledge that any so-called
party was in progress. Tempi in,
the owner of the garage, three
young ladies, including the Mizer
girl and Earl Mizer, the brother
of the girl, were in the garage at
the time. The doors were not
locked, neither were the curtains
drawn, the room in which the
parties were, faced upon the pub
lic street and had a glass door and
large glass windows, nor was any
effort made to hold a party. As
soon as Walter discovered that the
Mizer girl, whom he had never
met before, was drinking Intoxi
cating liquor, he took the bottle
from her.
PIRATES ATTEMPT TO
TAKEjHIP; SUBDUED
Hong Kong, Feb. 21. (By As
sociated Press.) While the Chi
nese Bt earner On Lee, carrying
more than 200 passengers, was
voyaging last night night from
Hong Kong toward Konkmoon,
pirate aboard suddenly opened fire
on the main deck. Chief Officer
Martin immediately directed In
dian guards to prepare to defend
the bridge.
With all lights extinguished,
Martin guided the ship back to
ward Hong Kong, Near Castle
Peak rockets fired from the ves
sel attracted a police launch,
which escorted the On Lee into
Hong Kong harbor. A large num
ber of suspects were taken from
the ship to the police station. It
is believed the pirates cast their
arms overboard. There were no
casualties.

derstood are already taking steps
to get his name placed on the bal
lot. Erixon, himself, is not saying
much about the situation, but
when It was put up to him recent
ly at a meeting of a local civic
organization he did not deny the
report ,in fact maintained a dis
creet silence.
However, those behind the
movement are prepared to wage a
regular campaign. It Is known,
providing they can convince thetr
candidate that be should get Into

ynon, assistant United States at
torney, and Barnett H. Goldstein,
attorney for the defense, in the
celebrated Bend calf case on trial
oerore Federal Judge Bean.

took to be an intimation that he
nau falsified to the court. Mr.
Bynon had told the court that no
Ole Swanson could be found in
Bend by the United States mar
shal and Mr. Goldstein, in his ad
dress to the jury, seemed to inter
that Mr. Bynon had not told the
truth.
Mr. Bynon jumped to bis feat
with the threat to thrash the at
torney for K. B. Hellemn, who fc
on trial on a charge ot using the
mails to defraud in connection
with the purchase of calves.
"I'm not afraid of yu,M de
clared Mr. Goldstein.

TOURS UPPER VALLEY
The Kimball School ot Theology
Glee club left this afternoon an a
two days southern concert tour.
This evening they are to appear at
Junction City singing under the
direction of Rev. Hutchinson, and
tomorrow night at Wendllng un
der the direction of Rev, Leslie
Bailey, pastor ot the Methodist
church there and Kimball gradu
ate. A week's tour of towns in the
vicinity of Salem Is planned for
the middle of April. The club has
already arranged to sing at Mol
alla, Gresham, Pleasant Home,
Sherwood, Willaminla, Lalamo,
Washington, and Portland First
Methodist church.
