Judge George G. Bingham in which
the suit of J. F. Day against' Lenora
Day is dismissed will probably cause
the complaining, husband to conclude
.that divorce court procedure encom
passes many pitfalls.
J. F. Day as plaintiff recently fil
ed suit for a divorce from his wife.
alleging that she had been guilty of
such cruel treatment of himself that
he had been compelled to leave thir
home. Among other allegations, the
plaintiff had charge that. Mrs; Day
had on one occasion handed him a
gun and told him to "blow his
brains out." -
In findings and conclusions, the
court noted that testimony submitted
by Mrs. Day shows that in September.
1918, the plaintiff began to pay at
tention to another woman, causing

1919, when they ceased to live to
gether. The wne!usion makes obser
vation tkat "while defendant may
have ush1 strung and forceful lan
guage : in opposing plaintiff's . con
duct, such was provoked by the at

The court decrees that plaintiff is
not entitled to a divorce order and
judgment is entered in favor of the
