NOTICE OF BALLOT TITLE FOR THE May 15, 2018 ELECTION
NOTICE IS HEREBY GIVEN that on January 3, 2018, the City
Recorder, received from the City Attorney the following ballot
title for a measure to be referred to the legal voters of the City:

On December 11, 2017, Wallowa Resources Community Solutions Inc. filed a notice of intent
to construct a qualifying conduit hydropower facility, pursuant to section 30 of the Federal Pow-
er Act (FPA), as amended by section 4 of the Hydropower Regulatory Efficiency Act of 2013
(HREA). The proposed Triple Creek Ranch Hydro Station Project would have an installed
capacity of 85 kilowatts (kW), and would be located along the 18-inch-diameter Triple Creek
Ranch irrigation pipeline. The project would be located near the Town of Joseph in Wallowa
County, Oregon.

QUESTION: Shall the City of Joseph repeal its ban on the sale,
production and processing of recreational and medical mari-
juana?
SUMMARY: On December 3rd, 2015 the City Council adopted
Ordinance 2015- 02, declaring a ban on medical marijuana
processing sites, medical marijuana dispensaries, recreation-
al marijuana producers, recreational marijuana processors,
recreational marijuana wholesalers, and/or recreational mar-
ijuana retailers. The Petition seeks to repeal the ban estab-
lished by Ordinance 2015-02 and allow medical marijuana
processing sites, medical marijuana dispensaries, recreation-
al marijuana producers, recreational marijuana processors,
recreational marijuana wholesalers, and/or recreational mari-
juana retailers in the City of Joseph.
NOTICE IS FURTHER GIVEN that any elector of the City who

Qualifying Conduit Hydropower Facility Description: The proposed project would consist of:
(1) a new generating unit, having a generating capacity of 85 kW, housed in a new 13-foot by
17-foot powerhouse, connected to the existing 18-inch-diameter Triple Creek Ranch irrigation
pipeline, and (2) appurtenant facilities. The proposed project would have an estimated annual
generation of 153 megawatt-hours.
A qualifying conduit hydropower facility is one that is determined or deemed to meet all of the
criteria shown in the table below.

The City of Enterprise received a City Initiative Petition on De-
cember 19, 2017. It has been determined that the petition meets
the procedural constitutional requirements. Any elector may
file a petition for judicial review with the Circuit Court of Wal-
lowa County no later than 5:00 p.m. on January 12, 2018, which
is at least seven business days after this notice.

The conduit the facility uses is a tunnel,
canal, pipeline, aqueduct, flume, ditch, or
similar manmade water conveyance that is
operated for the distribution of water for
agricultural, municipal, or industrial
consumption and not primarily for the
generation of electricity.

Preliminary Determination: The proposed hydroelectric project will utilize an existing irrigation
pipeline, the primary purpose of which is to irrigate Triple Creek Ranch’s farm. The addition
of the Triple Creek Ranch Hydro Station Project will not alter the conduit’s primary purpose.
Therefore, based upon the above criteria, Commission staff preliminarily determines that the
proposal satisfies the requirements for a qualifying conduit hydropower facility, which is not
required to be licensed or exempted from licensing.
NOTICE IS HEREBY GIVEN that on January 3, 2018, the City
