LEGAL NOTICE LEGAL NOTICE ORDINANCE 346-15 2015 FORECLOSURE LIST ISSUED BY WALLOWA COUNTY AN ORDINANCE OF THE CITY OF WALLOWA DECLAR- ING A BAN ON {MEDICAL MARIJUANA PROCESSING SITES, MEDICAL MARIJUANA DISPENSARIES, RECRE- ATIONAL MARIJUANA PRODUCERS, RECREATIONAL MARIJUANA PROCESSORS, RECREATIONAL MARI- JUANA WHOLESALERS, AND/OR RECREATIONAL MAR- IJUANA RETAILERS} AND DECLARING AN EMERGENCY THE CITY OF WALLOWA ORDAINS AS FOLLOWS: Whereas, the Oregon Medical Marijuana Act, as amended by House Bill 3400 (2015) provides that the Oregon Health Au- thority will register medical marijuana processing sites and medical marijuana dispensaries; Whereas, Measure 91, which the voters adopted in Novem- ber 2014, directs the Oregon Liquor Control Commission to license the production, processing, wholesale and retail sale of recreational marijuana; Whereas, section 133 of HB 3400 provides that a qualifying city may prohibit, within its jurisdiction, the establishment of certain state-registered and state-licensed marijuana busi- nesses by adopting an ordinance within 180 days of the ef- fective date of HB 3400; Whereas, City of Wallowa is a “qualifying city” as defined in section 133 of House Bill 3400 (2015) because the City of Wallowa is located in the county in which not less than 55 percent of the votes cast in the county on measure 91 in No- vember 2014 were against the measure; Whereas, the City Council wants to prohibit the operation of Medical and Recreational Marijuana processing site, proces- sor, producer, retailer, wholesaler, in the City to protect and benefit the public health safety and welfare of existing and future residents and businesses; NOW THEREFORE, BASED ON THE FOREGOING, THE CITY OF WALLOWA ORDAINS AS FOLLOWS: LEGAL NOTICE PUBLIC MEETING NOTICE Wallowa County Public Transit Advisory Committee meeting at Community Connection conference room, Enterprise, or, Wednesday-October 7th, 2015 at 9:30 a.m. This meeting is to discuss and make application for available transit grants. Medical marijuana dispensary means an entity registered with the Oregon Health Authority to transfer marijuana. BAN DECLARED, As provided in section 133 of House Bill 3400 (2015), the City of Wallowa hereby prohibits the estab- lishment of the following in the area subject to the jurisdiction of the City.
