Jefferson court
cases reported
Sptcltl to Tht Bulletin
MADRAS Two criminal cases
and a civil case were heard by
Circuit Judi;e Robert H. Foley
last week in the Jefferson county
courthouse. All were jury cases.
Tomas Alan Tucker was found
not guilty of a charge of burg
lary not in a dwelling. He was ar
rested along with two ex-convicts,
Jack Grove and Richard Ander
son, for breaking into the Rain
bow Cafe in Madras last Janu
ary 2. Grove and Anderson both
pleaded guilty and were given 10
year sentences earlier. Tucker,
who pleaded not guilty, said that
he was hired to drive the car and
was not an accomplice.
Ray Allison Rogers was found
guilty of assault with a danger
ous weapon, and Judge Foley or
dered a pre-sentence report by
the State Board of Parole and
Probation. .Rogers had been
charged with assaulting a Mad
ras police officer, Bill Fitch, in
front of the Shangra-La restaur
ant and bar July 21, 1961.
In the civil suit, James Dodge
was granted a judgment for $8,-
270.08 in an action against Pacific
Supply Cooperative. The litigation
arose from inadvertent poisoning
of potato fields, when they were
to have been sprayed witn an in
secticide, on June 29, 1959.
Dodge had sought $24,000 dam
ages, based on the amount he
could have sold the potatoes for
in the spring. The amount allow
ed was the maximum permitted
by statute, and was the value of
the estimated potato crop at har
vest time.
