man was killed and eight persons
were Injured today when a Rock
Island railroad passenger train
hit a city bus at a crossing and
hurled it into a motionless freight
train.
Robert L. Bowman, 40, Des
Moines, died after the accident.
The bus driver and seven other
passengers were Injured and two,
Edwin Nelson, 43, and Fred
Wright. 32, were In poor condi
tion, hospital attendants said. 1
The train was arriving here
from Kansas City. Mo. Police
said "nine persons, Including the
driver, were aboard the bus.

On Rent Control

Two federal Judges have Issued
opposite opinions on Ihe question.
Judge Klwln K. Shaw of Chicago
ruled the law unconstitutional
last July 20. On Aug. H, Judge
I-eon It. Yankwlch. 1-os Angeles,
held lo Ihe contrary.
The government appealed the
Chicago case lo Ihe supreme
court. The suit was started by
housing expediter Tighe K. Woods
In an efloi I lo keep Shoreline Co
operative Apartments, Inc., from
evicting tenants. Less than 65
per cent of the Shoreline stock
holders lived in the apartments.
Therefore under rent control reg
ulallons tenants could not be
evicted in order to give stock
holder occupancy.
Shaw held that congress Illeg
ally delegated its powers when it
included the so-called "local op
tion" section in the law. This per
mits decontrol of rent on the
voU? of a state legislature or even
of a local governing body, If the
state governor approves.
'There Is a grant of unbridled
administrative discretion subject
neither to reason nor findings of
fact," the decision said.
Shaw said congress could never
have passed the law at all with
out these local option provisions.

sity of Tennessee zoologist says
the bald eagle, national bird of
the United States, 1 slowly but
surely disappearing from It No.
1 habitat, Florida' coastal and In
land waterway.
For 11 years. Dr. Joseph C.
Howell has been studying the
bald eagle population along the
Indian river between Cocoa and
New Smyrna, Fla.
The eagle population declined
almost 30 per cent from 1935 to
llMfl, Howell discovered, with 24
pair of eagle nesting in the '
sample area In 1935 compared '
with 17 pairs in 1946.
Howell blame it on the influx
of the human population. As men :
move in, Howell learned, the
eagles move out. What's more, he
says, some hunters thoughtless
ly shoot the majestic birds de-,
spite federal laws to protect I
