NOTICE
Notice of Public Hearing is hereby given that the City Council of
the City of Umatilla, in its capacity as the Contract Review Board
of the City and upon the request of the City Manager in accor-
dance with ORS 279B.085 (Special Procurements) and the City
of Umatilla’s Policy for Public Contracts and Purchasing, will meet
on Tuesday, July 6, 2021, in the City Council chambers starting
at 7:00 p.m. to consider the Request for Approval of the following:
Request for Approval to Award Professional Engineering
Design, Permitting, and Construction Oversight Services to
KleinschmidtR2: This request is submitted by the City Manager
to secure a Special Procurement, as defined by ORS 279B.085
and the City of Umatilla’s Policy for Public Contracting and Pur-
chasing (“PPCP”) Section VIII.B and Section X.B. The profes-
sional services are required for the proposed enlargement of a
surface water point of diversion and pump station generally locat-
ed on the south bank of the Columbia River approximately 3 miles
upstream of McNary Dam (the “POD”) and which are currently
owned and operated by the Confederated Tribes of the Umatil-
la Indian Reservation (“CTUIR”). Subsequent to any approval of
this Request, City Staff will enter into an intergovernmental agree-
ment (“IGA”) with CTUIR which will allocate to the City responsi-
bility for the design, permitting, construction, operation, mainte-
nance, repair, and replacement of the POD facilities as enlarged
(the “Project”). Once completed, the enlarged POD facilities can
then be utilized to divert, as authorized under applicable law, both
City and CTUIR water and water rights from the Columbia River
for beneficial uses.
Any affected person(s) may protest this Request for Approval by
delivering a written protest to the City Manager no later than 5:00
p.m. July 2, 2021. Such written protest shall include: 1) identifi-
cation of this Special Procurement, 2) a detailed statement of the
legal and factual grounds for the protest, 3) evidence or documen-
tation supporting the grounds on which the protest is based, 4) a
description of the resulting harm to the affected person(s), and 5)
the relief requested. The City Manager will issue a written dispo-
sition of the protest by 5:00 p.m. July 5, 2021 if any are received,
prior to the Council’s hearing on this Request for Approval on July
6, 2021 at 7:00 p.m.
A copy of the City Manager’s Memorandum to the City Council
that includes the Basis for Approval as stipulated in PPCP Section
VIII.B.1 is available for inspection immediately at City Hall during
normal business hours at no cost and will also be provided no
later than 5:00 p.m. July 1, 2021 in the City Council’s published
Regular Meeting City Council Agenda. Copies will be provided
upon request at no cost.
A protest submitted after July 2, 2021 by 5:00 p.m. is untimely and
shall not be considered. However, all members of the public are
encouraged and will be provided opportunity to provide comment
during the Public Hearing on July 6, 2021 at 7:00 p.m.
