The property is a 9.24-acre
parcel, currently zoned Tourist

way Sub District). The request is
to re-zone 1.83 acres of this par-

acres to be zoned Manufactured

Pursuant to ORCP 7 D(6), this is an action to establish an easement
on real property commonly known as Tax Lot 600, more particu-
larly described as Account No. 129461, Map 6N3521-B0-00600
(“Tax Lot”), which is adjacent to 52098 Sunquist Road, Milton-
Freewater, Oregon (the “Sunquist Road Property”). Tax Lot 600
was owned by Robert W. Buboltz, Anna M. Buboltz, Fritz Bade,
John Bade, and/or Herman Bade, who are now all deceased.
Plaintiff owns the Sunquist Road Property following a judicial fore-
closure action. A Barn that is part of the Sunquist Road Property
and owned by Plaintiff encroaches on the Tax Lot. Because the
owners of the Lot are deceased, Plaintiff is unable to clear title
without legal action. Accordingly, Plaintiff has filed this action to
establish an easement to cure the encroachment.
