Feds defer prosecution
of Kansas online
gamer in hoax case

WICHITA, Kan. —
A Kansas online gamer
whose dispute over a $1.50
bet sparked a hoax call that
resulted in police shooting
a man who lived at his old
address has struck a deal
with prosecutors that could
allow the charges against
him to be dropped.
U.S. District Judge Eric
Melgren approved on Fri-
day the joint motion for
deferred prosecution that
had been filed earlier in the
day by prosecutors and the
attorney for 20-year-old
Shane Gaskill of Wichita.
Such agreements typ-
ically result in charges
being dropped if a
defendant fulfills all its
conditions.
The judge deferred
court proceedings and dis-
covery during a period
ending on Dec. 31, 2020
and ordered Gaskill to pay
$1,000 in restitution, costs
and penalties as required
under the agreement.
The death of Andrew
Finch, 28, in Wichita drew
national attention to the
practice of “swatting,” a
form of retaliation in which
someone reports a false
emergency to get authori-
ties, particularly a SWAT
team, to descend on an
address.
“I think the diversion
agreement recognizes in
part that Gaskill’s involve-
ment in swatting was less
than the others,” said Jim
Cross, spokesman for the
U.S. attorney’s office.
Gaskill is charged with
conspiracy,
obstruction
of justice, wire fraud, and
making false statements.
The other online player,
Casey Viner, 19, of North
College Hill, Ohio, has
pleaded guilty to conspir-
acy and obstruction of jus-
tice under a deal in which
both sides recommend two
years of probation. He will
be sentenced on June 26.
Authorities said Viner
recruited Tyler R. Barriss
to “swat” Gaskill in Wich-
ita stemming from a dispute
on the game Call of Duty:
WWII. Barriss, a 26-year-
old Los Angeles man with
an online reputation for
“swatting,” called police
from Los Angeles on Dec.
28, 2017, to falsely report a
shooting and kidnapping at
that Wichita address. Finch,
who was not involved in
the video game or dispute,
was shot by police when he
opened the door.
Barriss was sentenced
in April to 20 years in
prison after pleading guilty
to 51 counts for making
fake emergency calls and
threats around the country,
including the deadly hoax
call in Kansas.

THURSDAY
12:20 a.m. — An employee at the Chev-
ron station at 309 S.E. Nye Ave., Pendleton,
told police a male was outside yelling at
other employees. He left before an officer
arrived.
12:07 p.m. — Emergency services
responded to a two-vehicle crash at North-
east Fourth Street and East Punkin Center
Road, Hermiston.
1:12 p.m. — Hermiston police dealt with
graffiti on East Catherine Avenue.
12:58 a.m. — A caller in Hermiston on
Southwest Ninth Street reported a drunken
driver hit a car and took off.
7:40 p.m. — Stanfield police received
a 911 repot of a suspicious male at Center
Market, 530 N. Main St., Stanfield.
10:51 a.m. — A caller at the Umatilla
RV Park, 1551 Sixth St., Umatilla, reported
someone harassing people about the prop-
erty of a dead tenant.
9:16 p.m. — A caller in Hermiston
reported seeing a male wearing black
pants and a “white wife beater shirt” hide
in a dumpster. He was gone before police
arrived.
11:32 p.m. — A Weston resident
reported telephonic harassment.
ARRESTS, CITATIONS
•Umatilla Tribal Police arrested William
Joseph Elk, 48, and Lavey Dedier Vigil, 46,
both of Pendleton, on drug charges. Elk is
in the Umatilla County Jail, Pendleton, for
dangerous drugs and criminal activity in
drugs, both felonies. And Vigil faces felo-
nies for violating probation, felon in pos-
session of a weapon and methamphet-
amine possession.

Man sentenced to 5 years for racist threat to pregnant woman

FULLERTON,
Calif.
— A California man was
sentenced Monday to five
years in prison for mak-
ing racist threats against a
pregnant African Ameri-
can woman in a court-of-
fered plea deal that rankled
prosecutors and commu-
nity advocates.
Orange County Supe-
rior Court Judge Roger B.
Robbins made the offer to
Tyson Mayfield, noting no
weapon was used or injury
caused during the crime.
Prosecutors sought a
38-year-to-life sentence for
Mayfield for threatening
the woman, who was eight
months pregnant, and her
unborn baby last year at a
bus stop in Fullerton, Cal-
ifornia, prompting her to
use pepper spray to protect
herself and eventually run
for help.
Authorities said May-
field, 43, who is white and
has a swastika tattoo and
several prior convictions
for attacking bystanders,
including punching a man
outside a supermarket in
2017 while yelling racist
slurs.
“Quite frankly, your
honor, he scares me,” Dis-
trict Attorney Todd Spitzer
told the judge in opposing
the deal. “He is indiscrim-
inately picking out people
when he doesn’t like the way
they look and using violence
against them.”
