PUBLIC SAFETY
THURSDAY
2:17 a.m. — A 911 caller reported hear-
ing four gunshots on Southwest 13th Place,
Hermiston.
5:34 a.m. — A Pendleton police officer
assisted an officer from the Umatilla Tribal
Police Department with a “combative” per-
son at the Umatilla County Jail, Pendleton.
7:05 a.m. — The Umatilla County Sher-
iff’s Office took a report for graffiti at the
old Rodeo City Inn, 4149 Barnhart Road,
Pendleton.
11:11 a.m. — Umatilla police took a
report for the theft of tools and other prob-
lems in the parking lot at Novedades Cruz,
1360 Sixth St., Umatilla.
11:14 a.m. — Umatilla police received a
complaint about damage at the end of the
new road where people were shooting at
Beach Access Road and Highway 730.
12:16 p.m. — Hermiston police
responded to a report of an assault on the
1300 block of Southwest Porter Court.
9:15 p.m. — A bullet grazed the fin-
ger of a Pendleton woman while she was
un-cocking her revolver.
Pendleton police Lt. Charles Byram
reported officers responded to a home on
the 600 block of Southeast Eighth Street on
a report of an accidental, self-inflicted gun-
shot wound that resulted in a minor injury.
The investigation revealed the home-
owner armed herself with her .357 revolver
after hearing what she believed to be a
prowler in her backyard. She checked out-
side, found no one on her property and
returned to the house. There, she tried to
un-cock the hammer to render the gun safe
but fired off a shot.
The round grazed a finger on her left
hand, according to Byram, and medics
treated the wound at the scene.
Byram also reported Pendleton police
are not recommending criminal charges as
a result of the accident.

•Oregon State Police arrested Vikki Rose-
ann Garver, 64, for first-degree criminal
mistreatment, first-degree theft, first-de-
gree forgery and credit card fraud.

Closings over in trial of white cop who killed black teen

jury was set to begin delib-
erating Friday in the homi-
cide trial of a white former
police officer charged with
killing an unarmed black
teenager outside Pittsburgh.
Former East Pittsburgh
Police Officer Michael Ros-
feld acted as “judge, jury
and executioner” when he
gunned down 17-year-old
Antwon Rose II last sum-
mer, Assistant District
Attorney Jonathan Fodi said
in his closing argument.
The defense has argued the
officer felt threatened and
was following his training
when he fired.
Rosfeld, 30, shot Rose in
the back, arm and side of
the face after pulling over
an unlicensed taxi that had
been used in a drive-by
shooting. Rosfeld ordered
the driver to the ground, but
Rose and another passen-
ger got out and began run-

ning away. Jurors saw video
of the fatal confrontation,
which showed Rose falling
to the ground after being
hit.
Rosfeld could have
waited for backup or given
chase, Fodi said, adding
that teenagers sometimes
run from police. “Is it fool-
ish? Yes. Does it deserve
death? No. Is it reasonable?
Absolutely not,” Fodi said.
“There was no need to use
deadly force.”
Rosfeld told the jury he
thought Rose or the other
suspect had a gun. The
defense said the shooting
was justified because Ros-
feld believed he was in dan-
ger and couldn’t wait for
other officers to get there.
“He’s a sitting duck,”
defense attorney Patrick
Thomassey told jurors in
his closing, asking them to
consider “the standard of
what a reasonable police
officer would do under the
circumstances.”
Prosecutors charged Ros-
feld with an open count of
homicide, meaning the jury
can convict him of murder
or manslaughter.
The defense asked Judge
Alexander Bicket to acquit
Rosfeld of all charges, but
the judge declined.
“We believe the jury
has enough information
to arrive at the right con-
clusion: that Antwon Rose
was murdered,” the fami-
ly’s attorney, S. Lee Merritt,
told The Associated Press in
a courthouse hallway. Mer-
ritt said “it’s pretty obvi-
ous” Rose was not a threat
to Rosfeld.
Rose had been riding
in the front seat of the cab
when another occupant,
Zaijuan Hester, in the back,
rolled down a window and
shot at two men on the street,
hitting one in the abdomen.
A few minutes later, Rosfeld
spotted their car, which had
Ex-teacher gets prison for repeated sexual abuse of student
PORTLAND (AP) — A
former Tigard High School
teacher and coach admit-
ted to repeatedly sexually
abusing a student and was
sentenced to two years in
prison.
The Oregonian/Oregon-
Live reports 41-year-old
Marcus D. Jolley pleaded
guilty
in
Washington
County Circuit Court to sec-
ond-degree sexual abuse and
was sentenced Thursday.
He admitted to sexual
contact with a student near
the high school and in a
church parking lot between
July 2005 and December
2005.
Additional allegations of
abuse of that student and
a second girl in 2016 were
dismissed as part of a plea
agreement.
A judge also ordered Jol-
ley to serve five years of
post-prison
supervision,
register as a sex offender
and have no contact with
schools or children.
Court documents say an
investigation began in 2017
after a high school senior
reported abuse by Jolley the
previous summer.

At the beginning of the
trial’s fourth day Friday, a
defense expert, retired Penn-
sylvania State Police Trooper
Clifford W. Jobe Jr., returned
to the stand and repeated his
belief that Rosfeld followed
proper procedure when he
shot Rose.
Under cross-examination,
Jobe agreed with Fodi that
a police officer can lie, vio-
late the law or be unreason-
able. He also agreed with the
prosecutor that in some cir-
cumstances, it is reasonable
to refrain from shooting or to
disengage from a situation.
