SUMMARY: This rule propos-
es revisions to Oregon Admin-
istrative rules to (1) implement
a recent change in statute and
(2) correct an omission of a test
parameter from a section of rule.
The Pasteurized Milk Ordinance,
a national model ordinance that
ensures consistency of dairy
product safety across the U.S.
requires that a milk producer’s
license must be suspended fol-
lowing a milk sample violation
for antibiotics. Until the 2017
legislative session, a provision
in Oregon law prohibited ODA
from suspending a producer’s
license for a first violation. Since
this provision was inconsistent
with the requirements of the
PMO, ODA submitted a legisla-
tive concept to change the law,
and this change became effec-
tive January 1, 2018 as a result
of HB 2255 (2017). ODA propos-
es to revise our rules to allow
suspension of a milk producer’s
license for a first positive antibi-
otic violation, which will bring us
into consistency with the nation-
al Pasteurized Milk Ordinance.
We also proposed to correct an
oversight in a section of our rules
that related to other milk safety
violations. Somatic cell counts
are an indicator of animal health
and milk safety, and Oregon has
adopted maximum standards for
somatic cell counts in milk sam-
ples in rule. A separate section
of the rule addresses suspen-
sion of grade designation priv-
ilege for repeated violations of
milk safety standards, and the
term “somatic cell count” has
been inadvertently left out of
this section of the rule. We pro-
posed to add the term “somatic
cell count” to this section of the

Stage Gulch Trail - 2018. The Work shall include constructing an
8-foot wide gravel pathway between Sherman Street and South
Edward Road.
