TRUSTEE’S NOTICE OF SALE
The Trust Deed described herein is a residential trust deed, as
defined in ORS 86.705(6). This Trustee’s Notice of Sale could
be subject to the mandatory resolution conference requirements
applicable to residential trust deeds being foreclosed in Oregon
after July 11, 2012. See ORS 86.726 (2015). However, the lend-
er and current beneficiary of the Trust Deed is exempt from the
requirement, pursuant to ORS 86.726(1)(b). A copy of the bene-
ficiary exemption affidavit for 2018 is on file with the Oregon De-
partment of Justice.
A copy of the Exemption Affidavit, required pursuant to ORS
86.726(1)(b), was recorded on behalf of Columbia State Bank in
the real property records of Umatilla County, Oregon on February
8, 2018 as Document No. 2018-6680447.
Reference is made to that certain Trust Deed (hereinafter “Trust
Deed”) made by Jeffry Alan Smiley, a single man, as Grantor, to
AmeriTitle, as Trustee, in favor of Columbia State Bank, as Bene-
ficiary, dated September 22, 2014, recorded September 25, 2014,
in the mortgage records of Umatilla County, Oregon as Document
No. 2014-6210200, and covering the following described real
property situated in the above-mentioned county and state, to wit:
Lot 12, FRUITVALE SUBDIVISION, located in Section 21,
Township 6 North, Range 35, East of the Willamette Meridian,
Umatilla County, Oregon.

gerald Ln., Milton Freewater, OR 97862 (the “Real Property”).
The undersigned hereby disclaims any liability for any incorrect-
ness of the above-described street address or other common

The undersigned as successor trustee hereby certifies that no
assignments of the trust deed by the Trustee or by the Beneficia-
ry and no appointments of a successor trustee have been made
except as recorded in the mortgage records of the county or coun-
ties in which the above-described Real Property is situated to-

sor trustee; further, that no action has been instituted to recover

be due had no default occurred), together with costs, trustee’s
fees and attorney fees and costs, and by curing any other default
complained of in the Notice of Default, that is capable of being
cured by tendering the performance required under the Note or
Trust Deed.
Finally, notice is hereby given that without limiting the trustee’s
disclaimer of representations or warranties, Oregon law requires
the trustee to state in this notice that some residential proper-
ty sold at a trustee’s sale may have been used in manufactur-
ing methamphetamines, the chemical components of which are
known to be toxic. Prospective purchasers of residential property
should be aware of this potential danger before deciding to place
a bid for this property at the trustee’s sale.
In construing this Notice of Sale, the singular includes the plu-
ral, the word “Grantor” includes any successor in interest to the

About Public Notices

INVITATION TO BID
DAYVILLE SCHOOL ACCESS IMPROVEMENT PROJECT
Sealed bids for the “Dayville School Access Improvement Proj-
ect” will be received by the Dayville School District 16J until 2:00
P.M. local time on May 18th, 2018. Bids will be opened and read
aloud at the above time and date at the Main Office of Dayville
School District 16J, 285 School House Rd, Dayville, Oregon. Bids
will later be reviewed by the office for compliance and a recom-
mendation made to the School Board for approval.
The point of contact for this procurement will be the Lonnie Dick-
ens, Head of Maintenance. All questions or issues that may arise
regarding bidding, bid award process, or specifications shall be
directed to the Project Engineer or Mr. Dickens. The official re-

A non-mandatory pre-bid site visit will be held April 27th, 2018 at
10:00 a.m. local time; meet at the front of Dayville School, 285
School House Rd, Dayville, Oregon.
The work consists of the following construction:
Demo of existing concrete, ramps, misc. excavation and removal
of existing awning. Re-grading of sidewalk areas, ramps, and new
base rock. New concrete sidewalks, ramps, driveway approach-
es and curbs per new layout and ADA standards. Parking lot im-
provements include; miscellaneous excavation, placement of new
¾”-0” crushed rock and grading per plan. New Awing’s in several
locations, including roof system, lighting, support post, and post
foundations. Other miscellaneous improvements include; install
new door in existing stone structure, new railings, ADA grab bars,
a catchbasin, 12” storm drain pipe, new sewer service, and con-
duit sleeves for future use.
Work is to commence within 10 days of the date of the Notice to
Proceed and shall be completed by August 22nd, 2018, unless
extension is approved.
Contracts will be awarded to the lowest responsive and respon-
sible bidder meeting all the requirements of the bid submission,
qualifications, references, and specifications offering the total
lowest price. Dayville School District 16J reserves the right to
withdraw any item(s) from the award if it is in their best interest.
Dayville School District 16J may cancel this procurement or reject
any or all bids in accordance with ORS 279B.100.
Eligible bidders must provide contact information and be on the
Bidders List. All proposals shall be made on proposal forms, ac-
companied by completed Bidder’s Certification Statements, In-
surance Requirements Form, Proposal Form, Bid Bond (10%),
and First-Tier Subcontractor Disclosure Form (within two hours of
bid closing). Once awarded a one hundred percent (100%) perfor-
mance bond and one hundred percent (100%) payment bond will
be required to guarantee the faithful performance of the contract.
