Standoff juror questions
impartiality of fellow juror
whose impartiality has been questioned.
Brown didn’t find that the juror was
biased and sent the panel home for the
day. But she gave defense attorneys
until Wednesday morning to find case
law that supports additional questioning
of the juror.
The jury is considering charges
against Bundy, his brother Ryan and
five others of conspiring to impede
federal workers from doing their jobs
at the refuge. They took over the bird
sanctuary Jan. 2, objecting to federal
land policy and demanding the U.S.
government turn over control of public
range to local officials.
In the second note sent by jurors, they
asked the judge: “If we are able to agree
on a verdict for three of the defendants,
but are at a standoff for the others, does
our decision for the three stand?” The
note does not identify the three.
Ammon Bundy’s attorney, Marcus
Mumford, argued that the first note
could be fatal to the government’s case.
“If we do not get to the bottom of
this situation ... I think we are inviting a
mistrial down the road,” he said.

PORTLAND (AP) — Federal prose-
cutors’ case against the armed occupiers
of an Oregon wildlife refuge hit a bump
Tuesday when a juror raised questions
about the impartiality of another person
on the panel.
Jurors sent two handwritten notes
to the judge that indicated they were
having difficulty reaching a consensus
after three days of deliberations.
In one note, a member of the panel
said a fellow juror mentioned that he
was “very biased.” The writer asked
the judge whether that juror, a former
employee of the U.S. Bureau of Land
Management, can be considered impar-
tial.
The federal agency manages the
Malheur National Wildlife Refuge in
southeastern Oregon that a group led by
Ammon Bundy took over for 41 days
this winter. During questioning last
month ahead of the trial, the juror said
he worked for the agency more than 20
years ago as a range tech and firefighter.

Ex-police sergeant gets life in
prison for wife’s killing
OREGON CITY (AP) — A former suburban
Portland police sergeant has been sentenced to
life in prison for his wife’s murder.
Lynn Benton was convicted last week of
hiring his longtime friend and her son to kill
Debbie Higbee Benton at her Gladstone beauty
salon in May 2011.
The Oregonian/OregonLive reports that
Benton waived his right to a sentencing phase
Tuesday and agreed to accept a true life
sentence. The sentence keeps the 54-year-old
Benton off death row.
The former Gladstone police sergeant spent
most of his law enforcement career as a woman.
He transitioned to male in 2010 before he wed
Higbee Benton. The gender reassignment caused
a rift between the couple and Benton moved out
of their home a month before his wife’s death.
Deschutes DA says judge’s gag
order violates free speech
SALEM (AP) — A district attorney in
Oregon is objecting to a judge’s gag order on a
murder case, saying it violates freedom of speech
and infringes on both his ability to consult with
the victim’s family members on potential plea
bargaining and on his rights to communicate
with the citizens he was elected to represent.
Deschutes County District Attorney John
Hummel pushed back against a judge’s order in a
motion filed Monday.
The judge has ordered all parties in the
case from making any extrajudicial statements
about it that could reach the public. Edward
Lara, of Redmond, is charged with murdering
23-year-old Kaylee Sawyer, of Bend.
Lara was a security guard at Central Oregon
Community College in Bend. His trial is
scheduled for October 2017.
Idaho, Eastern Oregon produce
more, larger onions in 2016
SALEM (AP) — Producers in the Idaho-
Eastern Oregon area saw onion yields that are
larger in both quantity and size this year.
The Capital Press reports that despite
the bigger yields in 2016, prices dropped,
meaning producers saw about break-even
earnings. The Idaho-Eastern Oregon growing
region has about 300 growers who produce
roughly 25 percent of the United States’
Spanish bulb onions.
Snake River Produce Manager Kay Riley
says the larger-than-normal crop led to
depressed prices, a situation made worse by
a strong U.S. dollar and weak export market.
Bulb onion prices are about 50 percent of what
they were this time last year and nearing the
break-even price for farmers.
