Poll: Brown, Pierce in dead heat in governor’s race

Democrat Gov. Kate Brown and
Republican Bud Pierce are nearly
tied in the race for the state’s chief
executive, according to poll results
released Wednesday.
The poll by Clout Research,
a right-leaning irm based in
Columbus, Ohio, found Brown
holds a lead of 43.4 percent over
Pierce’s 42 percent. The margin of
error is 3.71 percentage points.
Pierce’s surge in support comes
mostly from independent voters.
About 41 percent of independent
respondents favor Pierce, while 29
percent support Brown, according
to the poll.
Pierce, a Salem oncologist, said
the results don’t surprise him.
“I think voters like my message
of being open and transparent
with them,” Pierce said. “Since
the primary election I’ve been
out in many Oregon communities
spreading the word about what
I would do to improve Oregon,
if elected governor. Kate Brown
has basically been an invisible
candidate, not attending debates
or answering tough questions. The
governor has only been accessible
to insiders and lobbyists. I’ve tried
to make myself accessible to the
people and the media.”
Brown’s campaign was not
immediately available to comment
on the poll Wednesday. Brown
and her campaign director are
attending the Democratic National
Convention in Philadelphia this
week.
About 700 voters responded
to the telephone poll, which was
conducted July 9-13.
The national polling company
serves mostly Republican clients,
but no one commissioned this
poll.
The poll also found that support
for a corporate sales tax measure,
known as Initiative Petition 28
or Measure 97, is eroding. About
39 percent of respondents favor
the measure, compared with 44
percent in early May.
Our Oregon, the nonproit
behind the corporate sales tax
campaign, dismissed the poll as
biased.
“This is a poll conducted by a
consistently wrong, right leaning
group,” said Katherine Driessen,

Oregon
spokeswoman.
“That’s clear based on their inac-
curate results throughout the poll.
Every single inding in this poll is
without credibility.”
Nate Silver’s FiveThirtyEight,
which rates pollsters on their accu-
racy, gave Clout a “C minus.” The
publication stated that Clout calls
races correctly about 33 percent of
the time.

Court overturns man’s conviction for killing baby son

PORTLAND — The
Oregon Court of Appeals on
Wednesday tossed out the
murder conviction of a Tigard
man serving a life sentence
in EOCI for the death of his
infant son, ruling that evidence
from the man’s internet search
history shouldn’t have been
presented at trial.
The appellate judges found
the warrant authorizing the
search to be “impermissibly
overbroad.” Barring an appeal
to the Oregon Supreme Court,
the case now returns to Wash-
ington County Circuit Court.
Kaliq Mansor called 911
on June 12, 2011, to report his
son Bryan was not breathing.
He told investigators he went
online for 15 minutes before
calling for help to conduct
research about what he
should do.
Doctors diagnosed the
11-week-old baby with
abusive head trauma and he
died two days later. Doctors
also examined Bryan’s twin
and found rib fractures.
Detective Robert Rookhu-
yzen obtained the warrant
to examine Mansor’s home
computers. The investigation
found Google searches from
June 9 that included terms
such as “abuser therapy,”
“father hates infant” “Oregon
child abuse laws” and “afraid
of abusing my baby.”
Before the 2012 trial,
Mansor’s attorney Russell
Barnett iled a motion to
suppress
the
evidence,
arguing the computer search
should have been limited
to the 15-minute period in
which Mansor was looking
up how to help the baby.
Washington County Judge
Donald Letourneau denied
the motion.
The appeals court opinion
states the afidavit seeking the
warrant established probable
cause to uncover Mansor’s
search history while the baby
was in his care June 12. But
the search encompassed all
data on hard drives and went
back years.
“Nothing in Rookhuyzen’s
afidavit established probable
cause that a temporally
unlimited examination of
the contents of defendants’
computers, including of iles
and functions unrelated to
internet searches and emails,
would yield other evidence of
the events of June 12, 2011,
or of any other crime,” the
opinion states.
Barnett said Wednesday’s
decision could have an impact
beyond the case at hand.
“It has the potential to
affect almost any sort of
search of cell phones or
computers based on a warrant,
and it will be interesting to
see how that law develops,”
he said. “This was really the
irst Oregon case addressing
this issue.”
The district attorney’s
ofice in Washington County
did not return a phone
message seeking information
on its plans to retry the case
based on other evidence.
Barnett said it’s a lock:
“I’m sure that the decision to
retry him was made before
they got past the heading (of
the opinion).”
Mansor, 38, remains in
prison at EOCI in Pendleton.
