1. Hawman Farms, Inc., an Oregon corporation doing business
under the assumed name Riverview Seed Company
(“Hawman”), claims a possessory lien under ORS 87.152 on
290,900 pounds of radish seed (species: Raphanus sativus L.;
variety: CCS 779) that was produced during the 2014
production season (the “CCS Radish Seed”) for services
provided by Hawman at the request of Cover Crop Solutions
LLC, a Pennsylvania limited liability company (“CCS”) and under
a certain Production Contract between Hawman and CCS
effective February 9, 2015. Hawman's services included
planting the radish seed stock that was furnished to it by CCS,
cultivating and caring for the growing crops produced from that
seed stock, harvesting those crops, delivering the harvested
seed product to Hawman's Riverview Seed mill and warehouse,
and cleaning, testing, handling and storing such seed product.
2. The actual or reputed owner of the CCS Radish Seed is CCS,
whose last known address is 201 East Oregon Road, Suite 103,
Lititz, PA 17543.
3. The agreed and reasonable charges for Hawman's services
(exclusive of storage charges) are $286,203.55. No part of
these charges has been paid except the amount of
$110,406.00. The total amount due to Hawman on account of its
lien claim (after giving effect to CCS's payment) is $175,797.55,
together with interest from and after October 15, 2015, at the
daily rate of $43.35.
