Mrs. Charles Polk.

Mrs. Polk Is survived by her husband,

SORY VACCINATION AMENDMENT
to the State Constitution to be voted
on by the people at the coming elec
tion, November 2nd. The health au
thorities, In these articles, attempt to
misconstrue and thus to mislead tne
public with reference to the scope of
this amendment and Its operation, and
with this object In view, sought and
obtained an opinion from a Deputy
City Attorney, that seems- to fit In
with the desires of the opponents of
this measure.
The undersigned deems it his duty
at this time, inasmuch as he prepared
the initiative petition incorporating
this amendment for the Public School
Protective League of Oregon, to de
fend this amendment against these un
just attacks.
There can be found nothing in that
amendment that can possibly warrant
the Impression toeing spread broad
cast by the health officers that it will
abolish the present laws or prevent the
passage of any legislation in the fu
ture covering reasonable quarantine
and oanltary practices by the health
authorities. Most of the people right
ly believe In quarantine end sanltarr
measures. '
Here Is the proposed Anti-Compul
sory Vaccination Amendment which
reads as follows:
No form of vaccination. Inocula
tion or other medication, shall be
made a condition in this state for ad
mission to, or attendance in, any pub- j
lie school, college, university or other I
educational Institution; or for the em
ployment of any person In any capa
city, or for the exercise of ay right,
the performance of any duty, or the
enjoyment of any privilege.'"
There Is nothing In this amendment
that can warrant any such assumption-
that it will prevent quarantine of con
tagious diseases and the enforcement
of anltary measures. Quarantine is
not vaccination, inoculation or medica
tion. The only words that the opponents
of this amendment can possibly select
to mifceonstrue Is the phrase, "or oth
er medication," In the 'clause. "No
form of vaccination, inoculation or
other medication. They might con
tend that this phrase, being general,
Includes all kinds of medical treat
ment. If so, then our legal friends in
the City Hall apparently have failed
to apply the elementary rules of statu
tory construction In making their
"analysts" of this amendment for the
Health Bureau.
That this amendment,will abolish all
the health activities of the public au
thorities, that it will result in increas
ed epidemics and deaths, that It will
increase the population of the under
world, etc., are highly Imaginative as
sertions for which no basis can be
found in this amendment if the legtl
rules of construction are applied.
It Is an elementary principle or
statutory construction long establish
ed and recognised everywhere, uu
supported by a mass of precedents,
following particular and specific
words, the former must be confined
to thmgs of the same kind. This Is
shown as the rule or doctrine of ejus
dem generis." (Sutherland on Stat
utory Construction, Vol. 2, Sec. 422).
In the case of Nichols vs. State, 127
Ind. 406, the rule Is clearly stated:
"The rule is that where words of
particular description In a statute are
followed by general words that are
not so specific and limited, unices
them be a dear manifestation of
contrary purpose the general words
are to be construed as applicable to
persons or things or cases of " like
kind to those designated by the par
ticular words, to illustrate, in a stature
are the words "warehousemen, warf
lngers and other persons." The words.
"other persons" the court holds, "must
be understood to refer to the other
persons ejusdem geners" (same gen
eral character) "viz., those who con
duct the business of warehousemen or
wharfingers with some other pursuit,
such as shipping, grinding or manu
facturing." (Bucher v. Common
wealth 103 Pa.. St. 55) Many illus
trations from adjudicated cases could
be given If space permitted.
Applying this principle to our
amendment, the words, "or other med
ication," must be understood to refer
to any medication of the same gener
al nature or characte as described by
the words that precede the word
medication," that is, any process of
injecting Infectious matter into the
blood and body of the Individual.
It is not the purpose of this amend
ment to prevent anyone from volun
tarily submitting to vaccination or to
prevent any physician vaccinating
anyone who requests it. But it' Is
clearly the purpose and substance of
the amendment to prevent vaccination
being foroed by compulsory measures'
upon those who do not believe In the
so-called efficacy of vaccination end

abundant, notwithstanding the "sta

medical freedirn by voting YES on
the amendment entitled "Anti-Com-
Dulsory Vaccination Amendment.'
