PORTLAND, Ore., Dec 11. Coun ty Judge Cleeton Saturday upheld the validity of the Anna E. Dale will, which was the basis of a sensational contest between mother and daughter for the possession of a 130,000 busi ness block on Flanders street, be tween Thirteenth and Fourteenth. Ender the court's decision the prop erty will go to Mrs. Mattle Tobias and her 7 -year-old daughter, Helen, of Seattle. Mrs. Nannie Mathews of Pendleton, mother of Mrs, Tobias and daughter of Mrs. Dale, is the one who sought to break the will on the grounds that her mother was mental ly Incompetent to make a will and that Mrs. Tobias and her hushand, David, had unduly influenced Mrs. Dale against her daughter. Nearly two weeks was taken to hear the case and then Judge Cleeton made a strong appeal to the mother and daughter to get together and agree upon a division of the property. He took the case under advisement for a week, urging them to compromise in the meantime. Something Wrong, Says Judge. When the attorneys advised the Judge that no compromise had been reached, Judge Cleeton declared his belief that he had not been given all the facts in the case, as nothing had been presented in the testimony which would Justify a refusal on the part ot both mother and daughter to agree to divide the property. "There is something, somewhere that casts a portentious shadow that keeps these people apart," he said "and the court has not been advised what It Is." Judge Cleeton Tevlewed at length, in nearly an hour's discourse, the tes timony in the case. He said he could find nothing in the testimony to ade quately account for Mrs. Dale's es trangement from her daughter, Mrs. Mathews.' but It was apparent that during the closing years of the elder ly woman's life her affee'lons for her daughter grew less and her affection for her granddaughter and great granddaughter, to whom she left her property, grew more Intense. Judge Cleeton censured both Mm. Mathews and Mrs. Tobias for the small amount of effort put forth to establish Mrs. Mathews in the atfee. tions of her mother.
