(Continued from Page 1.) the library was between Umatilla county and the Pendleton library b.ard. The law under which th- contract was made specifies that the county may contract with any cor poration controlling a library i"" Pendleton library board Is not a cor poration and several attorneys con tend that the contract should have been between the city and the city ,.t Pendleton to make It binding. If the contract never has been le- gal It appears that ihe board known as the t'matllla county library board has had no legal status. It would seem to follow, then, that the city and county libraries nave never been lawfully merged In this event the point as to whether or not the dlsso- lutlon of the contract will hold sinks into insignificance. According to J. It. Raley, whose le- gal opinion has been asked, the sit - uatlon now is that of a dissolved patrtnership whose murines has not ' been setiieu auu 11 e wmno - 'county and city will have to reach I some immediate agreement as to the been settled and he tmnKs tnai uij management of the joint library un til the dispute is settled finally. Who Is ijlhrartan? As matters now stand, Miss Nason is not recognized by the board as li brarian. Miss Delano, one of the two assistants, resigned recently to go to Portland. Mra Hturgls had nygotla ted with Miss Gladys Smith of Wal lace, Idaho to succeed Miss Delano and Miss .Smith Is nare. However, the board last evening refused to cm ploy her without further considera tion, denying Mrs. Hturgls' right to act without authority from the board. School Days Are here. This leaves Miss Lois Crlsswell as the only librarian recognised by both fac tions. Mayor Best intimated this morning that If the contract Is declared void that the city is not bound to keep any agreement it has with the county rel Sttvs to providing funds for assisting In maintaining the library There is considerable speculation as to wheth er the fight will Jeopardize the Stui- gls library endowment was left for the library rund which of the Com mercial association. New developments are expected at almost any time. An adjourned meeting of the library board will be almost anv time. An auiourneu meeting of the library boaru will ue; held next Thursday evening and In I the meantime the matter will prob- j ably be brought to the attention ot I the council. Meantime Miss Nason is still on the jorj at the library She takes the po- sitlon that she is still in the employ ,,f the county and will remain at her pu8l until removed by the county COurt. Many expect the court to take .some action confirming her position before the present session closes. MIsh Nason Reports. Prior to her "dlsttUBMU" last even ing, Miss Nason submitted her month-' lv report. She called attenUou to the fact that during the month the library had been moved into the new building, stating that It completed the second step of the program she had mapped out when assuming her posi tion two and a half yeurs ago, the first having been the establishment of the county system. The third step, already accomplished, she stated, is the building of the new branch build ings at Milton and Hemilston and the securing for other towns of the coun- ty similar buildings. . in conclusion she stated that he- caU8e 0r present conditions in the II- brary board and because of her un- (,ertaln tenure of office, the affairs of the library were being handicapped, , anu sne urged that the board enter into a contract with a librarian for ttt least a year in order that a defl- no(( ,,rotfram coud be undertaken. jfrg gu,, Re-elected. lllgnts meetmg was the an- nuaJ one and offCers were elected.
