Waggener, for the Missouri Pacific Railroad company, to set aside Its opinion of January 9 in which the railroad was directed to pny the milling company $12,000 of the attorneys- fees accumulated in eight years of litigation. The railroad company, It Is reported, will appeal to the United States supreme court a third time. The controversy has been In the courts eight years. The old range war between sheepmen and cattlemen, it is believed, has again broken out in Crook county. Yester day four masked men attacked a band of sheep belonging to Isador Meyers, about SO miles east of Prlneville, kill ing a number of sheep and Intimidat ing the herder. The Identity of the masked men Is not known, as they made complete escape after the kill ing. The sheriff's office Is investigating the case and developments are expected. May t William Hume of Everett, Wash., 26 years old, who because of his diminutive stature, had played the character of "Jeff In a musical comedy company, was kill ed In a collision between a motor cycle on which he was a passenger and an automobile driven by H. Jack sen, a public chauffeur, near The Meadows, Just south of Seattle. Hume was only 39 inches tall and weighed 93 pounds. Eugene Rlney of Ever ett ( who was driving the motorcycle, escaped serious Injury. The police made no arrest, believing the accident unavoidable.
