Inasmuch as he partici pated in making the county attorney bill a law, he cannot serve as a dis trict attorney. The supreme court ba held that a member of a legis lature which creates an office cannot be appointed to the office. ! Governor West, however, says the last legislature did not create the of fice to which he has appointed Mr. Neuner.
