Judge Thomus Fitz Gerald, who is
a referee in bankruptcy, has been
notified that the U. S. federal court
of Portland has made permanent the
injunction restraining the sheriff
from seizing the property belonging
to tho estate of the late L. "T. Kidder
of Athena. This ends a fight which
has been continued through three
courts. George B. Kidder, adminis
trator, held a chattel mortgage
against the property which Referee

to be void and fraudulent as to cred
itors. The matter was then taken
up in tho circuit court by a Bult to
foreclose the mortgage. The sheriff,
acting under the instructions, at
tempted to seizo the property but was
prevented from so doing by a tem

Pendleton will not have a municip
al power and light plant in the near
future. All plans to acqure a power
site on the Walla Walla river to be
developed ultimately were abandoned
last night when the council voted to
return the option which it has held
for the past half year.
The action last evening was taken
because a caucus held a week ago re
vealed that the aldermanlc propon
ents of a municipal light and power
system were hopelessly in the minor
ity, several of the councilmeri who
had originally been in favor of the
idea having developed eltheranopposi
tion or an indifference. Chairman
John Dyer of the special committee
was the only one who held out
strongly for further negotiations but
when his associates refused to accept
his suggestion that the owners of the.

930 elk and 80,000 deer in the state
of Oregon, according to figures com
piled by Liibor Commissioner O. P.

It is estimated that Clatsop, Lin

have 100 elk while Columbia has 80,
Tillamook 75. Lane TO, Grant, Baker
and 1'matilla 50 each, Wallowa 45,

ACCUSED OF MERGING

Collins filed a petition in
chancery here yesterday alleging that
a merger or combination of interests
had been formed by the Southern
Railway and the Alabama Great
Southern and the 'Mobile & Ohio rail
roads in violation of the anti-trust law

quired to forfeit their charters in
