tion of the anti-trust law. Cases In
which decisions are not announced
today will go over to October. If de
cisions are adverse, motions for re
heating would also be car r1 el over
to autumn. There woull be little
hope of getting a rehearing of such a
carefully considered suit as that
against the "tobacco trust," but the
motion would give the corporation all
summer and much of the autumn to
reorganize.
Decisions as to dates fo.- rehearing
of important cases at the October
toi m will be announce! today. At
torneys for the states of Minnesota,
Oregon and Missouri have appealed
to the court for an early hearing in
the railroad rate injunction cases, and
it Is likely that these cases will be
given precedence in the calendar.
The Minnesota case is regarded as
highly important, because all the im
portant questions as to proper valua
tion and the income to whl:h rail
road stockholders are entitled, the
relative cost of doing lnters'ato and
Intrastate business, and the Interfer
ence with which Interstate commerce
were all decided against the state by
Judge Sanborn. The Missouri case
was also decided against the state by
Judge McPherson, on account of the
alleged higher cost of doing intra
state business, although he rejected
the argument of the railroads that
state rates are an interference with
Interstate commerce. The Oregon
case was decided In favor of the state.
The supreme court therefore has a
wide variety of conflicting opinions
to deal With.

name of Walker, but who was none
other than "Mysterious" Mitchell, the
man who set the whole coast agog
last' year when he played with Frisco
by his eccentrlclticles and by his re
fusal to reveal his true Identity. He
only'lasted seven Innings, however,
for Buerstatte ordered him to the
bench when he refused to quit "rag
ging" at a decision. Hanson sup
planted him on the mound and pitch
ed good ball but could not hold the
local batters in pinches.
According to the gate keepers, fully
1300 people witnessed yesterday's
contest and there was an unusually
large number of ladies present. Wal
la Walla swelled the attendance with
an excursion party of over a hundred
and the rooting for both teams was
vociferous throughout.

Wala Walla was blanked during the
first four innings but Pendleton put
one over in the first when Dickson's
three bagger brought In Bliss who had
received a pass.
In the fifth, however, the Bears
took the lead when they chased In
three runs as the result of four er
rors, a single and a home run by
Pembroke. The . Buckarooes came
back In their half by getting a run
with two men down. Bliss was hit by
a pitched ball and took second on an
error. Kevins bumped the ball, send
ing Bliss home and landing safe
when the ball was booted.
In the seventh the score was tied,
Walla Walla making another and
Pendleton scoring twice. The visitors'
score came as the result of two hits
and an error while the locals made
their two through a base on balls, a
passed ball, a hit and two sacrifices.
Walla Walla again took the lead In
the eighth, but Pendleton promptly
came back with a run to tie the score
again, Berger and Whltten being re
sponsible with clean hits.
For four Innings then the game
went without a score being made by
either team, but It took some mighty
good baseball to shut both out for
several times runners got dangerously

Whltmore, one of the most promi
nent women of this section, shot and
killed herself at her home In West
Mayfleld today, using the same re
volver with which her son killed
himself at their summer home at
Crystal lake two months ago. In a

death was unbearable.

ERINGER CASE IS
CAUSE OF RUMPUS
Canton, O. The airing of charges
of heresy against Rev. Paul Eblnger,
pastor of the Tillomook Reform
Church and a member of the Port
land, Or., classls, accompanied by a
sharp tilt between delegates repre
senting tho Portland classis and those
from the Northwestern Synod, en
livened the meeting of the General
Synod of the Reformed Church here
this afternoon.
It la alleged that Rev. Mr. Ebinger
said to his congregation that the
word of God was contained In the
bible, but that not everything In the
Bible was the word of God. Also,
that in a sermon he expressed doubt
as to whether Moses wrote the ten
commandments. Another complaint
Is that he said that while the Israel
ites left Egypt to be sent to the
sent to the Promised Land, few of
them ever got there.
The Synod referred the charges to
the judicial committee, which asked
for the minutes of the Portland clas
sis containing the charges. The
Northwestern Synod representatives,
who had brought the subject before
the Synod after having declined to
act on it, said that the classis delega
tlon had the minutes. Tht delegates
denied it, a lively discussion follow
ed, in the midst of which one of the
delegates produced the minutes. The
Synod will act on the charge before
adjourning.
TRAIN HITS TWO
MEN NEAR MABTON
Mabton, Wash. A serious accident
happened last night on the outskirts
of Mabton, In which one man was
killed and another injured so that he
Is not expected to live. The men had
been stealing a ride on the freight
and upon reaching Mabton they were
put off at the station. The train then
pulled on to a sidetrack waiting for
N'o. 47 to pass. About this time the
two men tried to board the freight
again. It is not known Just how the
two men happened to both bo struck
by the Incoming train, but the opinion
is that they were pushed off by the
train crew as No.-47 was passing and
were In this way struck by the moving
train. No papers or marks of iden
tification could be found on either of
the men. The dead man was left In
Mabton, where he will be burled to
morrow. The injured man was tak
en to North Yakima and placed in
the hospital.
